Unless your neighbours have been negligent in some way then you should submit a claim via your own insurance. If you believe that your neighbours have caused the damage through negligence then you should ask for their contents insurance details as this policy will include public liability cover. |

I would suggest turning in a claim to your insurance carrier. Since I don't know which state you live in, it would be impossible to tell you if the other person could be held liable. If your insurance company thinks someone else is responsible for the damages, they will subrogate against them to collect the money they've paid out on your claim. And unlike what a previous responder said, most insurance companies won't increase your rates if a claim is not your fault. |

CONTACT YOUR INSURANCE COMPANY THEY MAY PAY OUT TO YOU BUT THEN THEY WILL CLAIM IT ALL BACK FROM THE COMPANY THAT IS INSURING UP STAIRS. WITH HOUSEHOLD INSURANCE THE PREMIUM DOES NOT GO UP IF THEY MAKE A RECOVERY OF THEIR MONIES. NOT YOUR FAULT AFTER ALL |

the owner of the building, due to the fact that it came from one of his flats. providing of course thy are rentals, if not I hope the upstairs tennant has a good insurance policy to cover all three |

You should contact your insurance company and make a claim, if appropriate. If they want to claim against the insurance company of the person upstairs then it's up to them.
You can try to sort it out yourself with the person upstairs if you want but you pay your insurance company to deal with these hassles! |

This is a building insurance claim.
As you are all in the same block of flats , you will all be on the same policy.
That policy will be held by the landlord, so contact him to make a claim.
It is the landlords responsibility to insure all the flats in the block for buildings insurance.
But your individual responsibility to insure the contents of each of the flats. |

the flat up from you is responsible and their insurance will need to pay out. Try to keep the discussions friendly though, it makes it all a bit smoother.
Don't contadt your own company as they will see this as reason for claim, even if you don't claim, and your premium will go up. |
