hitman K | Had a grease fire in my apartment what can i expect to be charged by my complex or does their liability cover. |
I was making dinner and started a grease fire. The sprinklers went off and they had to call carpet cleaners for my apartment and the two below it. I can't afford to pay what are my options. Additional Details isn't renter insurance only for personal belongings such as theft, natural disasters and what not. I thought the reason for homeowners insurance was for accidental damage to the building and such. |

You are screwed - whether he has insurance or not - he can sue you for the damages |

You needed to have renter's insurance. In addition to covering your property, it also provides you with liability insurance to cover damage that you become liable for as a result of your negligence.
For this case, it is too late. You are about to discover the cost of repairing property. In general, your landlord's insurance will pay for the damage. However, they are going to come after you to get their money back. |

They have no liability. You need renter's insurance. As for now, I suggest you talk to a lawyer. |

The apartment complex is likely to have some type of property insurance. Depending on the policy they took out, they may or may not have coverage for sprinkler discharge. I could not tell from your question if you carry Renters Insurance or not, but that policy would likely have been helpful in this situation.
Generally speaking, most Lease agreements will say that the Tenant is responsible for all damages they caused. I would assume that even if the Complex has their own coverage, the company would pay the claim and then send you a bill for reimbursement. I would make very nice with the Landlord and hope for the best.
If you have renter's insurance, speak with them IMMEDIATELY, so they can start collecting information about the claim. |

They'll have fire coverage, which may or may not cover sprinkler discharge. They're LIABILITY won't cover. YOUR liability likely won't cover THEM.
They're going to have a deductible, in any case - and it's likely to be at LEAST $1,000.
What does your lease say you have to pay? It will all come down to the lease/rental agreement. |

You did cause the damage to the building so you are liable for the repairs. If you have a renters policy, this covers your contents but also your liability. The liability on the policy covers damage that you cause to others but what you do or what you fail to do (accidentally of course, it doesn't cover anything you did on purpose). The owners of the complex may have a policy that will cover the damages, less their deductible. Then, since you caused the damage, if their insurance company covers it, they will come after you to collect the damages plus the deductible your landlord had to pay on his policy by what is called subrogation. If you have a tenants policy, they will pay up to your liability limit. If you did not, you will have to pay out of pocket - see if they will accept a payment plan from you.
This is why people should always carry a renters policy when they rent. You never know what can happen. It is not always a big deal if you have to replace your own things, but if you burn down a building by accident (& it does happen as I'm sure you found out), you could be held responsible & that is what a renters policy is really for ($500,000 liability & $20,000 contents, depending where you are is probably between $150 & $200 per year, which is so much cheaper than what you are facing now). You are actually pretty lucky, this could have been SO much worse...
I hope you have purchased a renters policy now! |
