Pooch Lover | Have I committed Homeowners Insurance fraud? Please Help!? |
I moved out of my house to an apartment. My daughter moved into my house. I quick claimed the house to her. I believe the quick claim put her name on the deed as well as mine. She pays the house payment. I called my insurance company and ask them to bill Jennifer my daughter for the insurance. They said they would check into it and return my call. Instead, they cancelled my "insurance" because I no longer live in my/our?? house. What do I do? Should I move back in..? Or what type of policy would I have to get? Please help.. Is this fraud??? ty for any good advice !!!! |

This is a pickle, but no, it's not fraud. It's misinformation. If you don't get the policies corrected and you submit a claim under the policy when you know you are ineligible for it, THAT'S fraud.
Please go look at your quit claim deed and see how you had it done. If the quit claim deed is written that you release the property from YOU to YOU AND YOUR DAUGHTER then the insurance company may allow you to keep your current policy by adding her as a named insured, then removing you as a named insured and making you an additional insured, owner non-occupant. If they don't allow you to do this with your current policy (most won't) then will need to get a new policy in your daughter's name only with you as an additional insured, owner non-occupant. You cannot be a named insured if you don't live in the house. You still need coverage, but it's slightly different than an owner who occupies the home.
If the quit claim deed is written that you release the property from YOU to JUST YOUR DAUGHTER then the insurance company is still correct to cancel the policy, as you no longer own the house (and your mortgage company will call the loan if they find out, unless they made some provision to have her assume your loan). You cannot insure the house if you no longer own it.
Either way you are likely going to have to have the policy re-written, unless you are still on the deed and move back in. Either way your daughter should be a named insured on the policy so she has the proper coverage.
Please call your insurance agent Monday to discuss all of this and get the ball rolling. The other answerers are correct in that you do not want to be without the correct coverage.
I'm also worried for you about the mortgage. Please make sure your ducks are in a row there so you are protected!

You and your daughter need to get to a local agents office ASAP and get some coverage on that house. Nobody here can sell you a policy so please don't wait to get to an agents office to buy a policy. You wouldn't believe how many claims I see happen during gaps in coverage.

you have not done anything wrong.
it seems to me like your insurance was through your mortgage company, and thats why it got cancelled when you quitclaimed it.
just call the insurance and have them start it again under your daughters name since she is the owner on the title. |

You have two separate problems. First, you may have screwed up the property title (see a real estate attorney). Second, you
(or your daughter) need to go get the right type of insurance. It's unclear from your statement who the legal owner is. |

~~I believe homeowners insurance should cover the homeowner. If you quit claimed the deed to her I don't understand the problem. You could have just continued the insurance on the dwelling and she could have taken out renters insurance, however since you deeded the home to her I don't understand. Did she get behind on payments, or have bad credit? Call your agent and ask why the reasoning on the cancellation then you can go from their. If their is a mortgage on it, they won't let it sit uninsured. They make pick a lousy and expensive policy and make you pay. Get professional help from an agent.~~ |
