I agree with mbrcatz. Your agent is your representative, and should fight for your benefits on your behalf. If they won't, I strongly suggest you find another agent to work with so you don't have this trouble in the future.

go talk to your AGENT. The only thing they should really be depreciating is tires. Unless there was other, pre-existing damage to the car? Let your agent intercede for you - that's what you PAY them for.

That is how the majority of auto claims are paid out. The theory is if your vehicle is ten years old and you need a door replaced due to vandalism why would they pay $1000 for a brand new one when you didn't have a new door to begin with. Insurance is there to bring you back to the same place you were before you filed the claim not make you better.
Unfortuantely, most people do not find this out until they make a claim.
