i was told by my attorney that he would take 30% of the settlement. i settled for $5000. but my attorney only wants to give me $2800. he says there are $800 additional fees. shouldn't all of his fees be included in the 30% that he receives??? |

Nope. Read the retainer you signed.
The 30% is his fee. For his service. The 800 is for copies, medical records requests, hours his paralegal worked, mileage etc.
Most attorneys take a fee of 1/3 (33%) plus expenses.
Also - your medical bills have to be paid out of the settlement proceeds as well. In general, you will end up with about 1/3 of the total settlement. |

The 30 percent that he took was for *his* fees (his "salary"). You would have owed him that much even if he hadn't spent a cent working on your case. The other fees he's talking about may be fees and expenses that he had to pay on your behalf to get the case settled.
Ask him for a complete breakdown of exactly what that $800 includes. |

That's what I love about ambulance chasers. You probably would've received more money dealing directly with the "big, bad" insurance company.
Like previous reposnders have said, the 30% is just his cut. The other money is for expenses like mileage driven to scope an accident scene, court reporter fees for depositions, etc. It's probably all in your agreement. Pull it out and read through it. |

It depends on what your AGREEMENT said. If it said, 30% plus expenses, then it's 30% plus expenses. Pull out your copy and read it. |
