missey | Hit and run covered up by the police. What do I do? |
Last year I was in a hit and run accident. The driver of the other car rear ended me and left the scene. We had bills from the hospital, ambulance, vehicle repair, insurance deductible, c.a.t. scan, medications, etc. This all needs to be repaid. I, my passenger and 2 witnesses gave the police officer the license plate number. Here it is about a year later and I still have not heard anything. I have 2.5 weeks left before the statute of limitations runs out on this. I want to sue, but I have no grounds until I find the information. Today I went to the Glendale police dept and bought a report for $5.00 so I could see the details. the part of the report for the hit and run man was totally blank. All it said was unknown. I was surprised and alarmed. I asked the officer at the desk about this and he said no information was given to the officer on duty. I told him the 4 people gave him the driver’s license number. Me, my passenger, 1 witness who for some reason was not listed and 1 witness who was listed. The fellow at the desk double checked for me and verified that no information was given. I told him that the officer on duty told me that the license plate was run and he found the man. He lives just down the street. The officer actually talked to someone at or near the man’s home and said that he would call me later with the details. That phone call never came. None of this was on the report. The desk officer said that if the license plate was listed anywhere, then it could be away for an open report. I would not have access to that. I would have to get an attorney to subpoena it. There was no answer as to why the hit and run man’s name, address, description and insurance information was never written down. At the time, I was comfortable that everything was taken care of so I did not keep the information. I called the one witness on file and he did not keep any information either. I do not believe the passenger still has it. Besides getting an attorney, what do I do. Call the officer? Any other suggestions? |

In Michigan, where I live, there is still something that can be done. My sister is a paralegal and says that the officer is required to provide a judge with written and/or verbal statement of facts not contained in a public police report (specifically when the victim is requesting a copy). It's part of our victim's rights laws. You can obtain valid legal advice through your area's free legal aid service. Most of the attorneys volunteer their time to assist clients with exactly these types of issues. Your local/district or county court is required to provide you with contact info for these free legal services. Try to do this right away. Also, you are supposed to get the officer's name on the police report. They have to provide this. If there is trouble with that, then there is also a recourse for the officer. Internal Affairs Divisions, etc. investigate these types of officer offenses. As for the medical bills, etc.- I work in that industry and I would say to call all providers (doctors, hospitals, etc.) to inform them that you have litigation pending in order to pay them off. Don't go into details, but most offices will pend your bill temporarily ( or write off small balances) to give you time to sort everything out. If it has been a long time since you spoke with these debtors, make sure to apologize first. It goes a long way. Good Luck! |

I am just curious as tp why you waited this long to get the report. That should have been done immediately. Now it is so far along I am not sure what you can do. Since there is not any physical evidence or a license plate number I do not think you can do much |

Have you reported this accident to your own insurance company. I am not sure that there is anything that you can do now, but if you had filed a claim under your uninsured motorist endorsement in your insurance policy, all of these items would have been covered. |

You don't have a lot of time to play with. An attorney would likely be your best bet as you let this go far too long without action. A good private investigator (which a good attorney will have) should be able to track down the vehicle from the plate. I would get with an attorney quickly, giving them the plate number and witness information (name, address, phone) so they can get the vehicle ID'd and suit filed quickly. They can John Doe a defendant or two just in case the owner of the unit is not the one at the time (vehicle sold,etc.) usually. Good luck. |

Look, YOUR INSURANCE COMPANY can run that plate. The police, I believe, cannot give you that information over the phone, it's subject to PRIVACY LAWS.
You can't have BOTH the vehicle repair bill, AND the deductible. If you paid a deductible, then your insurer paid the repair bill, and THEY have the right to sue this guy for reimbursement, plus your deductible - not you.
And you're not going to be able to sue this guy without a lawyer, anyway.
But usually, the statute of limitations is at least TWO YEARS. So I'm wondering if you have that info wrong?
You're going to need to find a lawyer TOMORROW, who can run the info and file the suit papers next week. You really can't do this yourself. |
