Home owners insurance being cancelled...am I right to be upset?
My husband and I recently did some research to find a better rate on our homeowner's insurance and found what we believed to be an excellent rate. The agent came out 4 months ago, took photos of our home, called us and quoted us a rate and we went in and transferred to them immediately.

Today I get a call from our agent telling us that the company our policy was issued from is cancelling our policy on January 5th due to "pre-existing damage" on our home. Apparently the agent said that he took several photos, noting that he had noticed a 12 foot long piece of vinyl siding was missing at the top of our 2 story home (blew off during a recent storm) but he purposely took an alternate photo that did not show the damage and that was the photo he had intended to send in... he told me "unfortuantely our part time employee accidentally sent in ALL of the photos I took and they are declining your coverage...so I just need you to fix that piece ASAP and I will come out and take a new photo..."

It is 2 days after Christmas...I have 5 children...My husband is exactly capable of installing this piece. It is 24 feet from the ground...not safe at all for someone with no experience. This leaves us to need to pay someone to do the work. I am upset. This agent did not inform us that he was taking photos to deceptively not show the damage in the first place. We assumed the rate quoted was with the home AS IS...Is there anything that we can say or do with our insurance company concerning this situation? I do feel it was highly unprofessional, a bit deceptive towards us and this deception is now costing us money "on the spot" that we didn't realize we needed and didn't budget for. My husband is calling them tomorrow.Are we better off not complaining and just getting it done one way or another or is there a complaint we may be able to file without agents company?

OK, first of all, if your agent is "scamming" an insurance company, that means that eventually, that company will cancel him. You DESPERATELY need a new agent.

Second of all, if your home is in less than perfect shape, it's kind of stupid to "shop out" the insurance to save a few bucks. Your agent SHOULD have tried to discourage you from that. He ALSO should have informed you that the insurance company MAY inspect the home.

Missing siding is a water damage issue - your house is more likely to sustain water damage with the siding missing.

Your best bet is to ask the agent to see if the company will give you 30 or 45 days to get the siding put back up - and have it put back up. Here's a clue - if the agent is NOT on the best terms with this company, they won't do it. In which case, you STILL need another agent. But, NO insurance company will be happy to write you with existing damage, not even the one you just cancelled. You've just shown them how loyal you are to them . . . they're going to show you the exact same loyalty - none.

Complaining isn't going to fix this situation. The agent acted in an unethical manner, trying to pass off a damaged house to the company. I wouldn't want to deal with a guy like that, for sure. If you DO complain, you can complain to your state insurance department, but don't expect that to change anything.

I would be more concerned with getting the siding fixed than worrying about who did what. Its cheaper to replace a piece of siding than to replace a whole rotted wall.
Most insurance companies will send an independent inspector out that the insurance agent has no control over. As a homeowner it is important that you provide annual maintenance on the house.

Unfortunately you have to fix your siding. The company that provides your coverage is well within its rights to make such recommendations. Not complying with company recommendations will get you cancelled.

Your agent should have seen this coming. But, either way you must comply with the company.

what your agent did was his job. many agents are required to photo all homes to send into the insurance company for review. Underwriter review them to determine if the home is an acceptable risk. A home without a piece of siding is a potential loss in itself allowing the elements to get in behind the siding and possible do greater damage. As a homeowner you have a responsibility of maintaining the house in such an acceptable manner and also to repair any damage to mitigate future losses. Why don't you just have the siding fixed? It has to be done anyway and it's already been four months that it's sat like that. Call your agent and advise this will happen in the immediate future and put him to work to advocate on your behalf to the insurance company. Your agent should try to reason with them to continue coverage under the condition that the siding is fixed. From what you describe, that may be in motion already but you only have a short time to get it done. You don't want a cancelled insurance policy on your record.

You need to see if there is a State Insurance Comptroller in your state. File with them about this--it is a deceptive trading practice that may lead further, especially if the "agent" recommends someone to fix the problem. Good Luck.

Here's the thing - the agent was trying to help you out by sending an alternate photo and this seemed to have been perfectly acceptable to you. Now that it didn't work, you are all upset about it. You have a duty to maintain your home and unfortunately, these things never come at a good time. An insurance company only has a certain amount of time to be able to cancel your homeowners after the inception date by law, so the issuance of the notice is pretty much a given. You will need to have the damage fixed before the cancellation date - (try to give them as much time as possible to reinstate the policy) & have the agent come back out and take a photo and verify the work has been done.

that was very unprofessional of the agent he should denied you the coverage from the start. ... all you can do is fix it and stay with that company or find another company but most likely they are going to require it to get fixed also............. You should also put in a claim for the company that was insuring you homw at the time it was damaged

if the damage was pre-existing and was damage that was cover under the old policy and old carrier, then maybe you should file a claim with them. you should get a couple of estimates from local contractors, to see if the cost even will exceed your deductible before contacting them.
you may have difficulty securing a claim on the old company, but if the pictures that were taken were dated and you insurance was enforce on that date, then you will have the 'proof' you may need. at any rate you will need a n estimate.

You have 2 issues.
As for the siding, yes, get it fixed, don't use a guy the new agent recommends but get it fixed. It truly is a hazard that should be fixed before worse things happen. It is possible the prior insurance company would take care of it, since the storm damage happened while you had it insured with them. Good idea to get an estimate first as you might not be talking about more than the home deductible.

As for your new agent. It is not ethical to take a misleading photo in order to get you a different rate or be accepted at all by the insurance company. He should be reported to both his insurance company and the state authorities. Once this situation is settled, definitely find a new agent even if you don't change insurance companies. It is likely they can assign you to a different agency without any fuss for you except to make the phone call to report his behavior.

If you are trying to avoid fixing it right away for monetary reasons, see if the company will take a work order that work will be done within 90 days as a sign of good faith that the hazard will be repaired.

Very unfortunate. Get it fixed ASAP, and get new insurance ASAP. Then talk with your state insurance department about possible deceptive practices of the insurance company that is cancelling your policy. You don't want to be without home owners insurance as it will cause a lapse in coverage which will make your new policy more expensive. Insurance companies do not want to see any lapses in coverage.

I'm sure you are frustrated by this situation. You've been backed into a bit of a corner because of the actions of the agent you've been dealing with. You could also consider applying for other insurance NOW, before the cancellation takes place. (Once you have had insurance cancelled by one carrier, you can end up with difficulties getting insurance from another carrier. Unfortunately, insurers share this kind of information.)
