I own a home, and have insurance, the coverage amount is 172000 on the dwelling, I owe the morgate company 72000 on the house. When it burned I was not staying at the house I was staying with my grandmother, I was buy there at least 2 times a day because my indoor cat was still there because I could not bring her with me. Sorry about the kitty. I was able to leave my independent cat alone for a few days at a time, but I admit one of my biggest fears was a fire while I was gone. I hope she turns up or I bet someone took her in.
As for the house, it's the property and contents that are insured, not necessarily the fact you live there. Plus, if it could still be considered your primary residence and you are just caring for your grandmother for a while, I really can't see where there's a problem. |

I agree that vacancy is a reason for them not to pay, however, if you can prove that you have maintained a daily upkeep on the house you should be ok. But it might be a tough battle |

I honestly don't see how the insurance can deny the claim simply because you were not there at the time of the fire. It would have been the same if you were on vacation or something. The only way that I know of that the insurance company could delay payment would be if the fire department determined the fire occured under suspicious circumstances. Have they determined the cause of the fire? If it was anything beyond your control the insurance company should pay off the claim. If they still rerfuse, I'd get a lawyer. |

I will disagree with other posters who say that vacancy has no bearing on your situation or whether coverage is in force. To the contrary, vacancy is a huge issue. Depending on your policy, which I highly recommend you read the vacancy section or talk to an agent about it, and state in which the policy is written, vacancy can suspend certain perils (e.g., vandalism) or can render the policy void. Different policies will define vacancy differently and those definitions rarely agree with our intuition. It is absolutely imperative you know what your policy says regarding vacancy AND how your policy defines vacancy.
I would recommend you seek the counsel of an agent.

The insurance policy typically reads it will not cover a vacant home. And the insurance definition is if the residence premises has been vacant for more than 60 consecutive days immediately before the loss, the insurance company has the right to deny coverage. If you have been performing the normal upkeep and have done reasonable repairs to prevent any losses while not occupying the home, I believe your home would be covered. |

No, vacancy is NOT a reason for the insurance to not pay on a fire. Once the house becomes vacant, the coverages that get suspended are vandalism, and water damage (burst pipes).
The only reason for them to not pay, is if YOU burned the house yourself, or if there was material misrepresentation on your application (ie, you lied about the occupancy, or about the updates, or about something else important).
Now, how MUCH they pay is a completely different story - if the house was insured to value, they should pay up to the policy limit to fix it. If the house was underinsured, they don't have to pay the full amount unless it was a total loss. |
