I have a small one bedroom rental property that a tree fell on recently. My question is what does depreciation value mean? It was a old frame house. There is major roof damage, all of the ceiling tiles fell off from every ceiling which gave way to water damage on the floors, the house shifted and I could not not get into any room in the house we had to kick doors open I cant open the closet doors to even get my renters stuff out.The adjuster said he would give me an itemised statement and if he hit my insurance limit he would have to stop. The house is unlivable even the siding is going to have to be replaced. I just fear that b/c of depreciation I wont get the money needed to fix it. Say if I do get the full amount insured which is only $45,000 do I have to fix it? Do I have to provide my renter with another place to stay and do I owe her anything for her contents in the house? |

The renters property is not covered by your policy. The renter would have to have a "renters policy" of their own.
Depreciation means that the adjuster will write an estimate to repair the home and will subtract for depreciation. That is the amount they will pay. It will not be enough to fix the house. You will have to pay your deductible and the deprecation (along with the insurance money) to fix it.
If the policy limit is 45K - and the estimate to repair - depreciation is over 45K - the most the insurance company can pay is the 45K.
Is the house financed? If so - the finance company will be on the check. Even if you don't fix the house - you are still responsible for the mortgage.

It sounds like the adjuster is going to hit the hi-water mark of 45k. You do not have to spend that money on the house, you can put the property up for sale as is. I believe that the renter's property will be included in the settlement, as would your property if you had been living there. That means that yes, you would have to pay the renter for her losses, it is included in the 45k you will receive. Hopefully, her losses will be included in the itemized statement.

It means cost to replace/rebuild, less depreciation for age.
If you have "replacement" coverage on your policy, it isn't a big deal. If you don't, and it sounds like you don't, with $45K of coverage, you could end up with quite a bit less than $45K.
Even if the house "totals out", he's going to have to hold back demolition and debris removal - probably around $10K.
You aren't responsible for your renter's stuff, and you aren't responsible for putting them up. But you will probably owe them back the rent they paid, for the time the place is unlivable.
