How and under what condition can sue someone?

When there is a breach in contract/agreement. And/or when bodily harm or malicious words said that could harm your creditability.

Theoretically, you can sue anybody for anything. I think the thrust of your question, however, is what is the right and appropriate time to sue someone.

Generally, you sue someone when all administrative remedies to resolve the problem have failed. A typical example would be if you fell at a grocery store because they had spilled spaghetti and didn't clean it up, you would be entitled to damages. You first approach the store about taking care of your medical bills and collateral expenses. If you get no relief from that method, then you go to the courts.

To get a successful outcome, you must be able to prove negligence which caused bodily injury or property damage. You cannot assume that you are going to get pain and suffering. Occasionally, I will get a guy who was bumped by one of my insureds. There is hardly any damage, but he's asking me how much he gets for pain and suffering. Geez!

Anyway, that's a basic primer. To make sure that the personal injury attorney will even talk to you, make sure that you're injured. They won't even make an appointment unless you're hurt. There's just no money in representing victims of injustice who are well.

Any time, any reason and any condition. Whether you "collect" however, has to do with legal liabilty and statutes of limitations. Check with the Legal Library in your state. Most statutes have the statute of limitations and the other information you need on the web for that state

You can sue someone for whatever reasons as long as you have proof of the following:

1) There's a violation of an agreement and/or contract (whether written or verbal)

2) They have breached an agreement

3) They agreed to pay you a particular amount of money and refused to repay you

4) They vandolized your property or something that belonged to you

5) They stole something from your house or residence

6) You can also sue someone for slandering your name, company, businesses, and etc. (Whatever is said about you must be true in order not to be considered slander, but if it's not true and it's said ... It is considered lible and the person doing it can be sued and will risk losing alot if a lawsuit and judgement takes place.)

Keep in mind that suing someone there must be a violation met that is required to be upheld by the law. You can't sue someone for example, for yelling at you pur se.

But pretty much everything counts!

God bless and Good Luck!

Much Love
Peace & Happiness

Here in the US, anyone can sue anyone else for anything. Whether or not you'll WIN is an entirely different matter.

Ted
If you believe that you have a claim against someone and the person has refused to acknowledge it, you may be entitled to take the person to court.

There are certain rights of appeal to a higher court that may be exercised if you are unsatisfied with the result of your case.
