How can I dispute an insurance claim?
I was in an accident while making a left turn. The other vehicle ran a red light and hit me. That driver admitted fault at the scene (their were no witnesses and no police report on scene) but now his insurance claims only partial responsibility, saying that their driver was simply going to fast for the conditions (wet road). How do I go about collecting for majority damages?

Are you carrying your own insurance? You should have reported this to your carrier who will assign an adjuster to handle the claim on YOUR behalf. it is obviously in the other's parties best interest to not accept responsibility. You need your carrier working on this and protecting your interests. Let the adjusters work it out.

Hopefully, you have comprehensive and collision coverages in place as well as uninsured/underinsured motorists coverage.

Call your insurance companies legal dept. and explain the situation. If they are not willing to help you, then go to an attorney who specializes in this area who will work on a contingency basis. You can also file a complaint with your state insurance commissioner. A lawyer specializing in auto accidents is your best bet, most will not charge you up front but will take a percentage if you win, it sounds if you are getting burned from your company not acting accordingly, and the other companies claims adjusters, who are low balling you which is their practice to save money. Good luck but don't settle for anything until you have a professional lawyer do the negotiating.

Go back to your insurance agent (remember, the guy you told about the accident the day after it happend) and ask his advice.

First off, when you take your driving tests, it states that you must be in control of your vehicle at all times. If the weather condition wasn't good, what was he doing going so fast? I would contact your insurance company and have them fight it out with his insurance company. And next time, always get a police report.

You file through your insurance, and let them handle it. Or, you decline their offer, and sue the driver directly in court.
