I want to notify the insurance company of the situation at the nursing home. my dad died needing cpr and cpr was not administered when he had a full code. it has been reported to the state. Additional Details The commercial ins agt. is correct. I filed with the state and they have determined he was full code. Problem, the nursing home put him on Hospice to change his benefit to get homecare is what his wife was told. she signed a dnr but nobody told him. no doctor was included which is mandatory. he asked for a feeding tube, psych treatment for depression, and rehab. he never was told. he was given a drug that was clear in his chart he was not to have and exhibited every side affect. as his condition worsened the nursing home did not call for a dr. they through me out while he was dying because i demanded an ambulance. i called in a nurse from outside for evaluation to move him and the nursing home told her he gained 1/2 lb that week and denied. they pulled the chart ignoring the code. they did not give him the nourishment. my daughter got 3 boost and 1/2 glass water down 2 hrs b4 his death. they kicked them out too. called 2 hrs later. thr dr diagnosed parkinsons. autopsy heart. |

I'm sorry for your loss.
But unfortunately, I don't think you're going to get the result you want by contacting the nursing home's insurance company. They aren't going to cancel a customer's policy just because someone called and verbally gave a complaint.
The proper channels would be to go through your state's complaint board/licensing board. The insurer is only going to get involved if there is a lawsuit filed. They are a business and make decisions based on issues that come up in court - not phone calls from their client's unhappy customers. (No matter how justified the customer might be with their anger.)

Contact the State Ombudsman. The nursing home will be able to give you this info or google your state and long term care ombudsman.
There really is no reason to contact the insurance.

It won't help you. You cannot submit a claim against another party's insurer. You would have to sue the other party directly. |

Send them a letter of intent. In the letter, write brief details of your loss. Post the date of loss, your dad's name, and your intent to file a claim. In the letter, tell them to refer the matter over to their general liability carrier. I am sure that they will. You will soon receive a call from the insurance adjuster.
Edit - Some of these other answers are just wrong. I handle Commercial claims, including General Liability claims, and MOST of the claims are claims, NOT lawsuits. You DO NOT need to file suit to recover damages.
Edit 2 - Yes, you will need to prove that the nursing home was negligent. This is your burden of proof. You may need an attorney who is experienced in these matters to step in. However, he/she does not necessarily need to file a lawsuit just to get the insurance company info. They can still just file a first notice of loss letter and/or letter of intent to pursue a claim. |

I don't understand why you would want to contact their insurance company. If you are wanting to report their negligence to somebody, you would want to contact your state's medical board. That is who needs to be notified if you want to report something that you think shouldn't have happened. If you do want compensation for what the nursing home did (or didn't do in this case) if you are wanting money from their insurance company, you are just going to have to file a lawsuit. An above poster said you don't have to file a lawsuit to make an insurance claim, but good luck in getting them to pay you just because you think they should. You are going to have to get a lawyer who is experienced in medical malpractice cases.
The most important question here is was your father a DNR? Did he sign a paper that said he didn't want heroic measures taken if he did code? If your father was a DNR then it would have been illegal for them to do CPR on him. More info is needed regarding this part of your question. If someone had come in and found your father had died in his sleep, they would not do CPR on him. However, if your father was sitting at the dinner table eating, then he coded, and had not signed a DNR, then yes, they should have done CPR and done other life saving measures. The truth is, though, most (not all) patients in nursing homes do have a DNR order in their chart. Nobody wants to live forever in a nursing home. You really need to get a lawyer and he/she will be able to help you sort out all of this mess. I am so sorry for the loss of your father. |

OK, you can't. They won't talk to you. Either you file a lawsuit and sue, or you don't.
Business insurance isn't like car insurance. You can't file a "claim". You can only file a lawsuit.
The insurer name is PRIVATE INFORMATION. If they won't tell you, you can't find out. But you can't do anything with it, anyway - as they flat out won't talk to you. |
