How can i sue my auto insurance co. for paying out a fraudulent claim?
they paid $75000 on a claim that they did not find anything wrong .I did not get a ticket for the accident and the person was not touched or hit or anything at all happend to him . Only thing that happend was he tried to jump in front of the car and he was pushing a shopping cart that did not got hit .and

any time there is a car and a pedestrian involved, 99.9% of the time the person driving is wrong (or will be declared wrong.)

Sure you dont like the outcome, but its not like you had to pay $75,000 out of your own pocket, cause thats what would have happened had you not bought the insurance in the first place.

This is america and you can sue anyone, but you'd be wasting time and money. Ocassionally, there are individuals that sue their insurance company for bad faith in claims handling and win.

But if you had the kind of money it takes to win a suit like this, you wouldn't be buying insurance in the first place.

Do the smart thing, save your money for your kids college, or retirement...

Sure, you can sue your insurance company. You'll have to hire a lawyer, and pay them up front. Monetary damages are, what, the surcharge on your policy, for the next three years . . . maybe $1,000 total. Your lawyer will cost you maybe $15,000, so that will be a loss of $14,000 - he'll probably ask for it up front.

Oh, and it's totally irrelevant that you didn't get a ticket. Sorry.

You also might want to know that pretty much any time there's a car and a pedestrian, the car is pretty much always at fault. And he could just be claiming emotional damages/suffering. Which you'd have to PROVE he wasn't emotionally damaged. Which will probably cost a lot more.

The insurer protected you and thereselves are required. You cant sue them, or do anything to dispute this, as they investigated and found probable cause that you were at fault to at least some degree (which can be as low as 1% in some states).

Think of it this way, the worst thing you have is an at fault accident on your record, the insurer is out 75k...who made out worse here ?

As far as the comment: "everyone who knows this person knows how he leaves (sic)..and how he leaves (sic)", not likely, insurers have a database where they track individuals involved in losses, it would spring up immediately if he were involved in other losses, and doubtful an insurer would pay anything on such claims.

Have you asked your company how they arrived at this settlement? If, indeed, they settled due to poor claims handling there could possibly be a bad faith situation here. You really need all the details first. Things go on behind the scenes that you would'nt believe during the claims process. If this person is indeed a pro then it could be that your company was against a wall and is simply taking the most practical way out. If they deny a claim without rock solid evidence to back them up they (and you) could be facing a five million dollar lawsuit. This is the lotto these scum live for and will keep faking injuries and accidents until they finally 'hit' the big one or (God willing) they are killed in the process. Cool off, talk with your company....could be they are NOT the one you want to destroy after all.

Believe me the last thing an ins. co. wants to do is pay a claim. If they did, with the huge Law Department that they have is because they did not see a chance to win the case.You did not get a ticket because being involved in an accident does not mean that you did any thing wrong in purpose. Is no law against a person being involved in different laws sues, it happens.

I am currently suing an insurance company as a "pro-se" plaintiff. I would first say that you need to determine what , if any, damages you claim. Then, if you feel you have been damaged, you should take your complaint to a qualified attorney. If you get an attorney to speak for you, it will get the attention of your insurance company. I would like to say that insurance companies try hard not to pay claims, and, they probably felt compelled to pay the claim for several reasons, such as, if the claimant had an attorney, it may have been cheaper to settle for the 75.000 rather than litigate!

Do you have any evidence that this person was paid by an Insurance Company before?

And even if he was. That only proves he is unlucky.

Why don't you hire a P.I. and bug his house and get evidence that he is really planning their accidents ahead.

Also you may have to testify in court and if he is not the mastermind but only an employee of a Cartel, Triad, Mafia, Yakuza or whatever you would be dead before you enter the Court.

Do you really want to risk your life for $75,000.00?
