My mistake was making a phone call to my insurance company to make a claim. We had a bad storm and it rained in my house, well the carpet got wet and the water leaked down the wall in my bedroom between the wallpaper and sheetrock down to the floor. We had a contractor come in and give us and estimate for our insurance company per their request. Well we got turned down on the claim because we were not covered for wind driven rain damage. However, we were covered for wind storm damage and rain damage but not wind driven rain damage. We decided to try and find another insurance company, because our current company doubled our insurance because of the huricanes that hit in '05 and because of the claims, so now we cannot get insurance anywhere else because no one wants to accept us because we made a claim on the "wind driven rain" which, need I remind you, we didnt even get paid for. They should at least give everyone a complimentary jar of vaseline and preparation-H. Additional Details For those who are unclear ex. dum drago. I didn't make a claim for huricane damage. They raised my rates to help those who had damage from the huricanes, who did not have insurance. The claim I made was a few months ago. My damage had nothing to do with a huricane. Furthurmore, I did not pursue anything, yet. And why do people have to respond to other people's questions and be a total D***. Please do not respond if your just gonna be ugly. |

You must contact your state's insurance commission and file a complaint. They can help you! Insurance is heavily regulated by both state and federal law. As a consumer, you have the right to have all valid claims paid. You can also contact your state's attorney general's office - they have people who help consumers mediate issues with businesses in their state. If they can't mediate for you, they can at least explain to you why this decision was fair.
If these two avenues fail, you can hire an attorney. I would do this as a last resort because plaintiff's attorney's make their money dragging these things out. It might eventually get done, but it will cost you in legal fees.

You need to talk to your agent, both to talk about your current coverage (and your lack of wind coverage - which in some states like TX and FL is a seperate policy), and to find a new carrier to cover you.
If your current agent isn't up to the task, you need to find a new agent. I'd suggest searching here: www.iiaa.org
And don't skimp on listening to the new agent - what's covered, what's not, and what they recommend. |

Many coastal areas exclude wind damage from the standard homeowners policy and make it available in a separate policy. If you live in one of those areas, then the decision by your insurance company was correct. You still could have avenues of recovery that a good attorney could help you with.
New coverage could be hard to find due to the increased risk of mold and mildew in a home that has had water damage. If all else fails, new coverage is generally available through a state insurance pool. |

and try to get that claim changed on your Clue Report (you may have to get a clue report for your physical address), if you can't, you can add a note on your Clue Report about what happened (Clue report is what insurers use to check your claim history), so insurance companies understand. You can also call your prior insurance company, and file a complaint, then call your state insurance department and file a complaint, and then ask what recourse you have from there. The insurance state department loves to fine insurance companies, if you give them a good reason why. That sounds silly. "wind driven rain". If you had wind and you had rain, I would think it should be covered. |

I think you need to get a mirror out and take a good long look at yourself. Being in a hurricane region it was important for you to ask questions, lots of questions before you bought.
This is further evidenced by dropping your current coverage before you moved to a new company.
I sense a pattern here and it is not the insurance company.
To be fair to you, I wouldn't take the first answer they gave me lying down. I assume you fought them, called your local ombudsman, made a pest of yourself? If you still got declined then it was probably correct and you have learned a couple of important lessons. It's called life. |

You have a couple of problems which should be directed to the Commissioner of Insurance in your state. After the disasterous hurricanes of a couple of years ago, many companies restricted payments and weaseled out of payments by claiming damages were caused by conditions other than those covered by the policies. See what the Commissioner says and name the company since they may have complaints from many other policy holders. |
