It depends on your state. In NJ there is unemployment "insurance" (through the state) which the employer pays AND the employee pays from a deduction from their paycheck. In NJ you can collect unemployment from being fired, layed off, almost anything. When I worked in NJ one employee was fired for fraud & was still able to collect unemployment. My employers unemployment premium doubled for 3 yrs & he was angry but couldn't do anything about it. I don't think it can be denied for very much in NJ. In VT & NH, if you are fired, the employer can deny unemployment. But, the employer pays 100% of the unemployment in these states. I guess you can only collect there if you are laid off or downsized.

just go to the unemployment office and apply, at worst you'll be penalized a couple of weeks. and by the way, Taxpayers pay NO part of unemployment. it is paid 100% by the employer.

Some employers hire employees who are not able to perform their jobs satisfactorily, or the employees aren't properly trained and are still terminated for under-performance. They are eligible for unemployment.
My father many years back was fired for running a personal errand on company time. He was paid on salary and all of his work was completed already. His coworkers and supervisors frequently ran errands during work hours, also. However, the employee handbook stated that this was not allowed. His boss didn't like him and wanted to find cause, so he was terminated based upon that rule, even though everyone else did it. He was granted unemployment. The company appealed, and he won the appeal. Labor laws are very pro employee, it's easy to collect, even if the company states that you were fired for cause.
