My ex and I were never married when we had our son so I am worried that if something were to happen to him, I would be stuck with just social security and I feel that is not enough to help our son with the needs in his life such as college, a house and other expenses. I have a policy on myself and our son is the beneficiary if something were to happen to me but his dad is very irresponsible and inmature so he doesn't have anything like this for him. So being that I am the more mature one, I want to take out a life insurance policy on my ex (which I would pay for) but I don't know how to tell him. I already know that I have to get his permission and have him sign all the documents in order to get a policy on him. I also know he is not going to be understanding so how would I introduce this to him to let him know it is for the benefit of our child? |

I would start the conversation by telling him you recently took out a life insurance policy on yourself for your son and then recommend he do the same (for his son's sake). Be polite and non-combatitive, but serious. Explain to him why you want to do this, and what would happen in th event of his death to ensure his son's wellbeing should the worst case scenario happen. Tell him you are even willing to pay for it, and he will put his son as the sole beneficiary. If he still balks at it, maybe if he has some family members you are on friendly terms with, you can ask them if they can reason with him. Unfortunately, if youre ex is irresponsible, it will be difficult to convince him to do anything, much less take the initiative to get a life insurance policy. It does require some patience with the forms to fill out and the required physical examination.

say you are worried about your son if something would happen to the ex, just say you want to do it for the benefit of the son, tell him you will make the son the irrevocable beneficiary so he knows you cant just change it to yourself
some courts have even ordered the ex to supply life insurance, you are responsible for the kid dead or alive |

I would simply tell him that you have concerns about your son's future and that you already have a policy established in the event that something should happen to you but you also feel that it is necessary for the same if something were to happen to him. As long as your son is listed as the beneficiary and not you and you are going to pay for it then I cannot see him turning down your offer....at least not if he cares about your son's future. If he wont go along with it, you can force him to get coverage through the court system. This is a fairly common occurrence.
Whatever you do, make sure you are the "owner" of the policy as the owner controls what happens to the policy. |

I don't believe it's possible for you to take a policy out on him yourself. However, if you have an attorney who handled your custody case, you could have him/her talk to your ex's attorney and recommend it. Or, if you have any contact with your ex's parents, you might be able to talk to them.
Life insurance can be a very touchy subject, so be kind about it. Remind him that it is for his son's benefit, not yours, and make a recommendation that the money be put into a trust to be given when you son goes to college or turns 21, rather than him getting it right away.
Also, if your ex is listed on your son's birth certificate (nowadays, it needs to be said), your son could be entitled to Social Security benefits if his father dies before your son's 18th birthday. In addition, if your ex served any time with the US Services, he would also qualify for his father's death benefits, as well as college money. This would, however, be void if the ex marries between now and his death. By all means, a life insurance policy is a better option.
Your best bet is to contact your attorney and find out what legal grounds you have. |

This is the sort of thing that courts are willing to order - if the beneficiary is the child, or a trust for the child. It could probably be put into the support order. |
