I had been using Allstate for my auto insurance since last summer and had no problems with them, no tickets or accidents but on May 19, 2010, I got a letter in the mail saying my auto insurance increased to $417 a month because they said my son had his drivers license. I called them on the phone and told them my son had taken drivers ed in Jan 2009 but never took the test to get his drivers license. He has not driven a car since he took drivers ed over 18 months ago. I told this to Allstate but everytime I called them on the phone, I would get someone in India who couldnt help me. I decided to switch insurance and went with State Farm. I went to an agent and explained to them that my son had his permit but wasn't driving and wasnt ready to practice or drive yet. They were very understanding and told me not to worry about it. A few days later, my children's grandmother passed away and my son went to go stay with my ex husband for the summer to help him ( he has a chronic illness). State Farm told me that Allstate should refund my money that I had already paid. My insurance was due on May 16 and I paid it on May 15,2010 and I cancelled with them 5 days after I paid them. Allstate is refusing to give back the money I paid for my insurance and I cancelled with them 5 days after I paid them. State Farm has told me they are suppose to refund my money and this has been going on over a month. What do I do next? I am tired of calling and getting someone over seas who has no clue what I am talking about. Sorry about the vent but this is frustrating. Additional Details I think Allstate will not refund my money because they claim my son has his drivers license and he doesnt. He doesnt even live with me and they are giving me the go-around on getting my refund. |

State Farm, can't tell Allstate what to do.
SOME insurance companies require drivers with PERMITS to be listed - because, as we know, they ARE actually driving the car.
So, Allstate got a DMV report, that your son is a driver in the household. Near as I can tell, he is - because he HAS a permit, and according to the DMV, he lives at your address.
I don't think you have a leg to stand on. Right. State Farm doesn't require permitted drivers to be listed - Allstate does. |

Whether you are due a refund depends on whether Allstate adds the charge for new drivers when they first obtain their learners permit or whether they add the charge when the driver is fully licensed.
All rates and rules used by insurance companies are filed and approved by the insurance commission in each of the respective states. From what it sounds like Allstate's rules contemplate the additional charge when the driver obtains a learners permit. If that is the case then you would probably not be due a refund because of the additional cost involved. Look at it this way if your son had driven the vehicle and been involved in an accident, Allstate would have had to pay the claim -- therefore they are entitled to collect the premium for the risk.

I work for an insurance company and yes the rates go sky high when you have a youthful driver, but with us you can sign a drivers exclusion (for anyone, not just youthful) and then they will not rate that driver. Also, with us when you pay monthly, you pay 45 days ahead of time, so if you just made a payment, you would have been paid up for 1 1/2 months. There should be money to refund. Look at the last bill you paid, and see what period it covered. If your cancelled before that, you are due a refund. It is called unearned premium (unearned by the insurance compay) and is refundable. There might be a slight early cancellation fee, but you are still entitled to refund. Talk to your agent, or go into an office and ask to talk too a supervisor. |
