Me & my partner were in a car accident 1 week ago. We were not at fault, but our car was totaled. Neither of us has been in this situation before, so we aren't sure what to expect. The driver who hit us was insured by State Farm.
We haven't received a settlement on our car yet, but we were told by State Farm we could submit a claim for pain & suffering along with any medical bills. So far our bills include:
1) Chiropractic visits
2) 2 Days of missed work (for both of us)
What would a reasonable settlement be (not including the car)? In other words, can we haggle or is there a min. amount we are entitled to?
Also - should we expect to receive the KBB value of our car? And can we counter-offer that as well?

There is no set amount that the insurance company has to pay you. In my opinion, you need an attorney to get anything near fair from an insurance company. They know their lawyers will never lose to a civilian in court, so they have no reason to pay you what is fair.
You should at the very least get compensated for any missed work and any medical bills. The insurance companies tend to employ tricks to keep you from hiring an attorney. IE: Telling you they will pay your medical bills only to find out later that they are now offering 30%.
In my honest opinion, to get the most money from an insurance company BY FAR, you need an attorney.
If you try to settle with the insurance company yourself, be happy if you get 100% of your medical bills and missed work wages. |

Insurance companies will not give you more than you are entitled. Add the costs of the chiropractic visits and the lost income, then submit your claim.
You CAN haggle with insurance companies. If you feel you deserve more then I would present a counter-offer with evidence of your loss. They would prefer to settle out of court, but they are very strict not to give you more than you lost. They do not want there to be an incentive for filing a claim other than restoration of damages incurred.
File all the information with your insurance company and then they will bill State Farm. |

KBB private party sale value, is approximately what you can expect. You might be able to haggle a few extra hundred bucks, but not more than that.
There's no "automatic" with the medical. Besides chiro, you'll have to include a medical doctor's bill - chiros aren't medical doctors, and can't, themselves, substantiate injuries. After all, you go to a chiro whether or not you're injured, for regular adjustments. So, medical will depend on the nature of your injuries, the amount of permanent disability, etc. If you didn't see a medical doctor, you won't get those two days of missed work. |

You will not get KBB for your car. If you check the fine print, the Kelly retail value says their value is just a starting point for negotiations. The figure includes sales commissions, advertising, reconditioning of the vehicle. All these expenses have nothing to do with a car's value.
IF the insurance company uses a book, it will be the NADA (National Automobile Dealers Assoc.) book. However, adjustments will be made to the book value based on your car's condition. So, if the tires needed to be replace, expect to see a deduction from the NADA value.
Most insurance companies use a market survey program. It determines the value of your car based on the recent sales price of similar vehicles. This is usually a more accurate reflection of your car's value.
As far as the car's value goes, the insurance company owes the actual cash value of your specific vehicle. That means, what your car could have reasonably sold for given it's age, condition, mileage.
As far as the injury claim goes. No one here can tell you what State Farm is willing to pay. It sounds like you and your husband have soft tissue injuries (sprain/strain). Those are usually not big claims. |

My husband and I were involved in an accident that damaged our truck and caused chiropractic & other expenses...I didn't want to hire an attorney so I went to the library and there was a book on how to settle my own car accident case...There are certain procedures to insure you get what you are entitled...Insurance adjusters are not honest...They are there to protect and serve their agency and want to settle immediately.
First...Don't settle right now...It is customary to wait at least 60 to 90 days to make sure there are no more underlying medical problems and expenses...And there very well could be unforseen medical problems that haven't produced themselves yet like whiplash and muscle spasms in which you would need more time off of work and more therapy...My husband felt fine and 2 weeks later he almost fell off the roof from muscle spasms and had to have intensive therapy.
Also...Check with your insurance company and see if they have a declaration that pays for any car rental fees and dr. fees that the other drivers insurance will end up paying back...Sometimes our own insurance company will cover certain expenses from other's mishaps...
Just remember above all...All insurance companies want to settle quickly before other expenses come about...For example...My daughter was in traction from an accident and the insurance company wanted to settle immediately and she still had months to go...So watch and cover your back...Of course her injuries were worse and it took 3 years to get what we asked.
Next...Your injuries are considered soft tissue injuries...Insurance companies have a formula which is the total bills times a percentage which I can't remember and may have changed since the 1990's...Ask the insurance agent what the formula is for soft tissue injuries...Educate yourself with this case...Insurance agents hate questions but have to answer.
As for the value of your car...Do a Blue Book Google and you can find that information but please don't settle immediately but wait at least 30 days if you can't wait out any more time.
