123unme | How do I handle a Big Corporation after a serious workplace injury?? |
Hi. I was seriously injured on the job a little over 6 months ago, and now the time has come when I am being "released", albeit gradually, by my doctors for "light-duty" ("20 hours/week-for first 3 weeks, and with an extensive list of "restrictions"). I will not be able to do my old job (which was extremely physical in nature) anytime soon, in fact, it may be another 6 months before I am back to full health - if ever (per my orthopedic surgeon). I have had 4 surgeries (including one for a skin-graft), and have 2 plates and six (remaining) screws in my leg. The corporate office (Internal Claims Mgr.) just called (and left a message) stating: they would like to talk to me regarding my "temporary return to work POSSIBILITIES with the company AT THIS TIME ... we need to discuss this - and have a DIALOG". What am I looking at here? There has been a MAJOR overhaul of management, etc., at the site where I worked (Virginia) in the 6 months I've been out, and this is a 101 year-old corp. Additional Details The company has been paying my medical bills, and paying my 2/3 income - though there was a 2 month hold-up on that due to me having broken my thumb, at work, THE DAY BEFORE the more serious leg injury (believe it or not), and question as to whether I was supposed to be AT work - doing what I was doing (driving a forklift) ... their lawyers FINALLY decided to "accept" my "claim". |

OK! Sorry to hear about your Injury and the difficulties you are having.
Insurance companies are strictly governed by the Law of the land...meaning the State dept of Workers compensation. By law they have to pay you for ( what you are now receiving).
HOWEVER. Insurance companies even though they cannot bend the rules can an most likely will "negotiate" with you a solution to your long term problem and ALSO help your employer in not "stuffing" him with a bad loss ratio...(which effects his Work Comp rates .
Every one wants to see a conclusion to a claim. What they are doing is "gradually" getting you back in the game by offering you Temp return to work job. Your Insurance company hand your employer has a "return to work policy" This is for your benefit. What happens is that your employer will pay you according to the wage of your assigned job AND the insurance company will pay the difference.
You will not get anything less in revenue. But will help BOTH the Insurance company and Your employer on the long run.
I would agree to this Temp job......You will not get better by laying around. You however...WILL make brownie points by getting up! |

Looks like you want peoples to say sue them, you could. Sounds like they are taking care of you. If they lasted 101 years, then they are aware and lawyered up 99 years ago. |

If you are on comp, no company is going to let you sit home if you can do something useful. That might be what they want to talk to you about. Perhaps they have a light job which you could do.
It might be nothing more than sitting in the stockroom sorting out tool requisitions. It certainly wouldn't be doing something you can't possbly do, or something that would possibly jeopardize your recovery.
It may be simple, clerical work. But it will be something that will, if you give it a chance, make you feel like you're doing something . And it will get you out of the house.
Talk to them. this is quite common with long term recoveries from major injuries. and I don't believe they have anything sinister in mind.

I'd becareful cuz as soon as you get back to work they my try to get rid of you. Where my mother worked they tried to get her to come back but she knew better. She worked with a girl who got hurt on the job and she went back and they canned her. My mom has been on workmens comp. for 3 years now and has extended it for another 3 years and is now sueing for her disability. Just becareful..... |

Lawyers don't accept claims, insurance adjusters do.
Those guys are probably going to give you a list of several light duty positions that fit the limitations your doctors have written up for you, and give you the options. Keep in mind, that if they are for a reduced amount of pay, the workers comp should continue paying THE DIFFERENCE, less taxes (the 2/3rds you were referring to). |
