Jill | How long after an ER visit can the hospital can a hospital send new bills? |
Hello,
I had an ER visit in 3/2/08 without insurance. I was seen by a triage nurse and discharged. I was told that my bill would be available the following monday. I called the next monday and it wasn't available. I stopped in 3 weeks later and they said that there was no bill for the service. In early November of 2008, I got a $180 bill from them for that visit.
I know that insurance companies have timelines that hospitals must follow and usually after 90 days or so, they will reject a billing due to late filing. Do I have any standing on not paying this bill due to late billing?
I had the money in March if they would have billed me on time, but due to the economy (I am self employed), I absolutely can not pay it, except for maybe a $5 a month plan, if that. Additional Details EDIT: I am on a payment plan for $2,000 bill with them for a later visit. |

Actually, most insurance companies have a 12 month claims filing limit. So, even if you had insurance, you'd still be within that.
But to answer your question...if you had the services, then you can be billed for them.
If you wish, you can request an itemized statement to verify that the charges are valid. |

Yeah sorry--you don't really have anything to stand on with this. They still have a right to bill you since you did have the services done. They should've billed you sooner as a business, but it doesnt' change that you owe it....sorry |

You do not have any standing on "not paying." Never ask ER personnel about billing; ask the hospital's billing or business dept. |

Tell them to add it to the payment plan. You still owe it, but they have a responsibility to send it in a timely manner. |

1. Most hospitals have a charity care write-off plan where they will give you a break even if your income is not at minimum wages.
2. Hospitals also will negotiate a self-pay discount. They may bill $180 for a service, but for someone with insurance, they will only collect a small portion. So the fee schedule is inherently inflated, so they would sometimes be willing to settle for less than what they billed because that's what they would have received from an insurance company.
3. See if they will tag this on to your payment plan without increasing the amount - they know how bad the economy is, and may very well be willing to take ten bucks a month. |

The hospital has 3 years to submit bills to you although it is rare to get bills over 90 days. At the end of the year the hospital will audit all the charts and send out any bills they missed. |
