There's no set time limit. Has the fire marshall issued a final report? They could be waiting on that, and if arson is suspected, it could go on quite a bit longer - like a year.
In any case, if it's a total loss, the mortgagee's still entitled to THEIR portion of the claim, so you can request your adjuster to pay THEM out, to get them off your back. If it's not a total loss, though, you're going to have to get your agent to kick things into gear. |

PS. - contrary to what others have told you - we are not scared of public adjusters or attorneys. So you can hire one if you want to ....but don't make a fool of yourself and call your adjuster and threaten them with it - you just look like an idiot. |

They're stalling you in the hope that you will accept their first lowball offer. If you had a significant amount of damage, the way to take charge of the situation is to talk to the adjuster at the insurance company and mention that you will be using a public adjuster to evaluate your claim. This will scare the bejesus out of them and definitely get their attention. They will react very negatively and you'll be getting a reasonable offer very quickly. If you feel the offer is rediculous or they're stonewalling you, then you can go out and engage a public adjuster..... for a fee (usually a percentage of the total settlement), he/she will evaluate your claim, prepare it and negotiate for you with the insurance company..... about 10 years ago we had damage from a roof leak. doing the above raised the insurance company's offer from $8,000 to $75,000....which was about the cost of repair and replacement of what was broken and damaged. |
