chapstick | How long can a person suck on workers comp?? |
i have a relative who worked for halliburton.. he says he got injured on the job, however i think he took a fall because he didn't want to be there anymore... he wanted out of his contract but they wouldn't let him.. he now draws a large sum of money each month and boasts that he wont have to work ever again... he did have to have surgery for his injury.... will he be able to live off of this for the rest of his life?? he also has never held any certain job for more than 2 years.. he has many degrees and is very smart, just lazy and always looking for the easy way out... |

I will disagree with the others who say this can go on forever. It can go on for what seems like forever (several years); however, the insurance company and the employer will only stand for that so long. With Work Comp there is designation called P&S (Permanent and Stationary), which means that the injured employee has suffered some type of Perm Disability and the disability is stationary--it's not going to get any better or worse with further treatment. Even if the insured is doctor shopping and constantly finding someone who will declare him as TTD (Totally Temporarily Disabled), there is a limit.
The amount of time is also dictated by the State your in. I assume that with this being Big Red (Halliburton) that you're either in TX, OK, or LA. I'm not as familiar with the statutes of those states so I can't say if there is a cap on the number of weeks of Temp Disability (as there is in CA of 104 weeks) an injured worker can receive.
I will say that in my experience most states cap the weekly amount of money an injured employee can receive. For someone working for Halliburton, I would be willing to go out on a limb and say that the disability from Work Comp doesn't come close to replacing their pre-injury income (unless they're filing Unemployment and State Disability claims simultaneously or working another job).
If you want to end their shenanigans, just call the employer's HR department and ask for the manager. Tell the manager what the employee is doing and let Halliburton and their insurer/reinsurer take care of the issue. |

I know people like that. {wish I didn't.} It can go on forever. They aren't just sucking worker's comp, they are sucking taxpayers. They are lousy, lazy moochers that think the rest of us should be handing them things, just because they exist. |

He could pull it forever.
If you can prove that his injury is fake or he's not as bad as he claims, Workmen's Comp would be very interested |

In theory, indefinitely. There's always doctors and attorneys out there willing to lie to keep their client off the job. Especially with soft tissue injuries.
Everyone has a "Uncle Tim" or similar person like this with a shady work history and dubious view on insurance and employers.
Many state departments of insurance, Workers Comp commisions and insurance companies offer reward programs. Christmas would be awkward however at the old homestead. |

It varies in accordance with the laws of the state where he works, the state where he lives, or the state where the company is domiciled. He can pick which laws he wants to go by, whichever are most favorable to him.
Workers comp won't pay once he hits retirement age. And some states limit "lost wages" pay to three years. Although there isn't enough information to answer the question, it is very possible that he will never have to work again. |
