How long does a settlement with an insurance company take?
A year and a month ago a drunk driver with a lvl 1.9 hit our car sending me and my 11 year son to the hospital me in a coma for 2 weeks and 3 surgerys and my son pretty good cut up ...well 10 months later he was chargered sentenced to 4 years which is pretty good in Tennessee. My question is this I hired a lawyer right off the bat and in two weeks they are going to take his depoisition, how long do these things take because honest I am at the point of just wanting this whole nightmare over with.... I know its going to take different time frames for different situations but has anyone else gone through anything simular? thanks guys

When you hire a lawyer, you're guaranteeing that it's going to take pretty much 2 -3 years. They slow things down drastically.

But YOUR LAWYER should be the one giving you the timeframe.

his insurance kept delaying,
finally after 5YRS.

As a former adjuster, I can understand your frustration and willingness to get matters resolved. The adjuster more than likely wants to get this matter resolved more than you do. Unfortunately, the other party more than likely has inadequate limits to truly compensate you for your damages. By your statement it appears suit has been filed because they are taking depositions. In all my handling of cases, once suit has been filed, the defense attorney's (for insurance companies) will want to take depositions of all interested parties before resuming negotiations. By nature of filing suit, you are now at the mercy of the court system which could take quite a bit of time. Neither the insurance company nor your attorney can push it thru the system any faster. The only way to get closure is to settle the matter out of court. With the other driver being drunk, sounds like their could be punitive damage issues that might require him to hire his own independent counsel which with three attorneys could take some time. Good luck and hopes this gives you some idea as to what you have in store for you.

The insurance company you are fighting against is using the time factor to wear you down, and it is working. It sounds like you are asking for money beyond medical bills. Lawyers typically are not in a hurry to solve this issue. If you want out, ask your lawyer what a buy out price would be to get out now. BUT be prepared for a much less settlement. 3 years is probably more typical. 2years, but you will still be giving up money.

I am going through something similar right now. We are not using a lawyer though. The insurance company said that they wait to make a settlement to see if you have any lasting or long term injuries. I know exactly how you feel about wanting the whole thing to just be done and over with. It is a stressful situation that I never would have guessed would be this draining on my whole life. I am only 4 months into it. I can't imagine how you must feel after a year of it.

I had a bad accident and it took about three years to settle - that's without going to court. Sorry, I hope this doesn't depress you, but it's true. Are you and your son stable - not getting any worse or better? If you're still healing, it may take longer. They will want to know how disabled (if at all) you will be.

I know this is hard, but let the attorney do the worrying for you. That's why s/he's there. Ask him/her how often you should check in, that you want to be kept up to date. I'd say every 2-3 months, or so.

Be patient - the insurance company isn't in a hurry, so try to just wait it out. I'm sorry you and your son are going through this. I'm glad they got the drunk driver off the road.
