If they were going to pay on your claim they certainly should have by now either way your agent should have contacted you by now as well to approve or deny your claim

"MarketSt" says that your agent will approve or deny you claim. The agent has nothing to do with approving or denying a claim. That job is left up to the company's claims adjuster.

Yes, your claim should have been paid by now, if it was a legitimate claim. If you have not received a denial letter, your claim is still pending, subject to an investigation of the claim.

Questions:

1. Were your insurance payments current at the time of the loss?
2. Did you purchase the policy from a local agent, or from an on-line only company?
3. Did you do everything possible to protect the damaged property from more extensive damage?
4. Did your loss include flood damage?
5. Was your loss questionable? (Caused by illegal activity)
6. Was the loss and claim a result of fraud?
7. Was the loss caused by an excluded activity, structure, animal, or object?
8. If it was a fire loss, was it caused by wiring done by a non-professional electrician?
9. If it was a fire loss, was it caused by a suplemental heat source, such as space heater, etc., which was not admitted on the application for the insurance?

Call the company's claims department and ask them what the hold up is on the claim. If you get no satisfaction, file a complaint with your state's insurance department, consumer division.

If the claim is questionable, don't make any waves.

Well, that's way long. They suspect fraud, or the claim would have been paid by now.

You don't say what type of claim it is, but you really need to call your agent, have your agent call the adjuster, and get a DETAILED list of exactly what the holdup is.

The normal timeframe for payment on a homeowners claim, varies as to the type of claim. It can be as short as 3-4 days, for small debris removal type claims (fallen trees), or months and months for a total loss to the house due to arson.

**ok, as per your memo to me, this is not YOUR claim! A dog bite claim on someone else's policy isn't yours!! So, this time frame, especially considering you think there will be plastic surgery in the future, is NOT abnormal! There won't be any settlement until the level of permanent scarring is determined. Which won't be until after the plastic surgery. It could be up to another year - and likely won't settle much before the statute of limitations expires in your state, or your child is completely healed. **

From reading one of the posts, it appears that your child was bitten by a dog. In most states, but not all, dog bites are considered "strict liability" especially if a child is involved. A claim could be denied if the child was above the age of reasoning and was tormenting the dog. You do not provide many details of the loss.

If your child is still treating, and it appears that plastic surgery may be considered in the future, then no settlement will be reached until your child is at a medical end result. Perhaps you should contact the adjuster and discuss the status of the claim.

In most states, any minor settlement needs to be approved by the court/judge. The settlement will be placed in an annuity or approved escrow account to be available for your child at an agreed age.
