Good luck on that, unless an employee of the alarm company committed the robbery, they're not responsible. You're going to pay A LOT in attorney fees up front.

I would do it right away while the police officer can still remember that they didn't hear the alarm or that it wasn't called it from the alarm company. Maybe your insurance company can help prove what the alarm company did wrong.

I am assuming that you had all windows/doors of your home locked up and the alarm on at the time of the robbery. Also, had you paid your bill and was your alarm contract current? Was your alarm system functioning properly at the time of the incident? Did you notify police of the incident?
Read your contract - does the company offer any kind of warranty against break in - in the contract? I would bet this question is answered somewhere in the alarm service paperwork.

The statute of limitations varies from state to state. You can look on-line for "statute of limitations" for a civil suit in your state and you should be able to determine how long you have. That just tells you how long you have to maintain a claim against the other person without filing a lawsuit to keep your case alive. In most states, there's a 2-year statute of limitations, meaning if you don't file a lawsuit within 2 years of the date of the occurence, your claim is dead in the water. I suggest you consult an attorney as it may be pretty difficult to prove any negligence against the alarm company. I can think of all kinds of reasons why they might not be held accountable for you being robbed.

The statute of limitations vary from state to state. They also vary depending on the cause of action (ie, personal injury vs. contractual). You'll want to consult a lawyer in your area to determine your correct limitations date.
