I'd just like to see how many YES answers I get... you can tell the whole story if you want to. My son was t-boned by an old lady turning left - he was going straight - and that was almost 4 months ago, and he still hasn't gotten them to pay a liability claim. Everybody we talk to - insurance agents - the car storage company - all say that State Farm ALWAYS does this. Now I know that they must pay SOME claims... so I don't really want to hear about those. I just want to see how many people DON'T get their claims paid by State Farm. Additional Details No her policy did not lapse. My son's insurance adjuster said that State Farm's agent wants to try to put some of the blame on my son. His company, Progressive, thinks it is ridiculous that a car going straight would in any way be at fault when somebody turns left into them and there is no damage to their front end at all. Progressive also said that State Farm does this crap all the time.
My son's insurance company has no concern for this incident because he carries liability only, and of course they aren't going to pay because he was not at fault. He was also pushed by this old lady into a 3rd vehicle who was stopped at the light, waiting to go straight. The 3rd driver is, I believe, also still waiting for State Farm to pay those damages incurred by their insured making a left turn. |

Being a former adjuster it depends on point of impact. Did your son hit the back part of the lady's vehicle? If so he may be on the hook for 20% of her damages and she may be liable for 80% of his damages. Even if this is the case, State Farm should have at least paid 80% of your son's damages already!
There must be something else preventing State Farm from paying. It's not in their interest to drag a claim this long since they risk litigation. Review the police report. Ask your Progressive adjuster to make a 3 way call to the supervisor of State Farm overseeing your son's claim with you on the line and all three of you check the status of the claim. I had to do this all the time even though my insured only carried liability only insurance. Then, tell the Progressive adjuster you will check back once a week for a status.
good luck! Ask the State Farm supervisor if the claim has been denied. He may say yes, but per privacy laws may not be able to tell you why. Claim denials can be for a lapse in coverage, excluded driver driving vehicle at time of loss, vehicle not on policy, etc.
There is UMPD which covers uninsured motorist property dmg and UMBI which covers uninsured motorist bodily injury claims. Both should be on your policy if you paid the premium for them. |

there's obviously more to this story in order for them to be dragging their feet on a claim, all insurance companies know you can sue them and they'd rather that you'd not, all your sons insurance company can do is sympathize since he only carries liability, and no you can't file uninsured motorist claim for car
damages because U/M only covers bodily injury not property damage |

Contact an aggressive personal injury attorney and file the claim with your own insurance. It should be covered by your sons uninsured/underinsured motorist policy. If he declined uninsured motorist then you are going to end up with an attorney.
If he DOES have uninsured motorist your insurance company will most likely pay the claim, investigate, and then go back to the other drivers company to get their money back. Its called subrogation. |

Let me ask this question a little different way....
How would you like it if you had to pay premiums to an insurer that paid claims that they didn't necessarily have to.
In other words, don't you want your insurance company to aggressively fight unnecessary or fraudulent claims to make sure that you are not paying too much in premiums?
If you don't then you must not care how high your premiums get.
State Farm obviously has questions about the accident and wants to make sure it doesn't have to pay a dime more than necessary.
And as a policyholder, I'd demand they do that.
I was hit by a State Farm policy holder about five years ago....they paid the claim in a very timely manner.
There's clearly something about this accident that is amiss.
I'd bet there is an allegation of insurance fraud somewhere because of the complexity of the claim. |

We've had State Farm Auto Insurance ourselves for about 20 years. Strangely in the last few years we've been in two car accidents where we've been hit by people who also had State Farm.
So we've never had a problem getting paid, but they do handle it weirdly. They have two different claim teams that both work for State Farm who fight each other for who is at fault and whose insurance pays (even though both parties are insured by State Farm). It's a little weird.
I know this doesn't help your problem, but I think it's a little interesting.
All insurance companies try to get out of paying whenever possible. That's how they make money. Take as much money in and pay the least out. That's the bottom line. |

some of the worst advice i have ever seen....look, State Farm is notorious for applying baseless comparative negligence. Your solution is simple: file a complaint with the DOI and they will soon be jumping through hoops to settle your loss. |
