I have heard of a test case that has gone through the courts in Devon where an Insurance Agent took the Financial services authority to court because he was ordered to pay £3,000 in compensation to the person that he has sold the Endowment to. The IFA has successfully got an agreement that if the endowment pays out the agreed amount at the end then the compensation will have to be paid back.. He is now trying to get a court order that states that if the endowment pays anything above the amount that he will also receive this money. |

You should expect nothing as compensation, whether or not you use a claims company, unless you can prove intentional fraud. |

The compensation should legally be enough to compensate the shortfall and no more. English courts tend to award damaged in a measured way to reflect the real loss, rather than to make the claimant rich. So if the forecast is a £1000 shortfall, a £1000 award would be equitable. |

Do it direct - most companies will work out values for you under approved guidelines.
Please note that the fact that the endowment will not meet forecasts is NOT per se evidence of mis-selling. If the company you bought it from can prove you were advised of the risk that the endowment would not meet the target then it is not mis-selling. (Many didn't because it looked like a 'sure-fire' way of paying of the mortgage and earning a nice commission. Others will have told their clients but can't prove that they did.)
In fact, if I remember, The mortgage lendors insisted on cautious (at the time) projections being made to safeguard against this eventuality. What happened is a) the dotcom crash of 1999 b) 9/11 c) reduction of interest rates - people did not use the reduction to pay of the mortgage but to increase spending. |
