Claim adjuster keeps saying she haven't received the required paper work that I faxed a long time ago for a medical leave of absence with total disability. I faxed the documents 5 times last week of required documents and received print out copied confirmations that she received them. Additional Details There is a total of 4 pages. She keep proclaiming that she only received pages 1,2, and 4 and not the 3 page????
There could be a problem with her fax, your fax. Or the fax is coming through but since the 1 machine is shared by everyone in the office the one page got picked up by someone else, ended up in their box. Sometimes when faxing multiple pages 2 pages will get stuck together and feed through at the same time-- one page gets missed that way. There are any number of reasons why it's not going through.
Contrary to popular belief -- adjusters have no reason to lie about something like that. All it does is create more work for us to do and we have way too much to do as it is. No need to lie about not getting forms and creating more work.
In the end, what's important is getting the forms to her.
So...call her up. Ask her for her mailing address.
Then send the forms to her by mail- certified mail - return receipt. Do not make it restricted delivery. Many insurance companies have a member of the clerical staff get the mail -not the adjuster. It's ok if a member of the clerical staff signs for the certified mail.

But anyone could have picked them up and walked away. You did not see her get them so you do not know for sure that she did.
I would send the documents to her certified mail with return signature so you know someone signed for it.

Start with your state's commissioner of insurance and your state's attorney general's office. This is both free and more effective.

You file the lawsuit, by hiring a lawyer.
You fax page 3 over, all by itself, and keep a copy of the confirmation sheet.
