How to get insurance to stop ignoring you?
So a few weeks ago i hurt myself on my landlords property. I filed an incident report but they seem to be avoiding talking to me. I also called a personal injury attorney and one of them wanted me to do all this work with the insurance and then he would come along and "help" me (yeah i think help himself to my settlement) So i called another attorney and he is supposed to call me within a week. Are these Personal injury attorneys always so busy they dont have time to do anything for you? I thought these guys were starving for cases and thats where they got the name "abulance chasers" Anyway, how do i get insurance to take me seriously or contact me back?

OK, they have NO duty of good faith towards you.

Landlords have TONS of incident reports, and an insurer isn't going to jump up and offer you cash, just because you filed one.

Any PI lawyer that can't return a call from a prospective client within a day, isn't going to return a call from an ACTIVE client, for weeks.

It's possible they are ONLY going to take you seriously, if you file suit.

Keep in mind, in order for them to pay you anything they have to determine that your landlord was NEGLECTFUL in something - that they knew there was a harmful condition, AND they didn't correct it. Just the fact that you hurt yourself, doesn't automatically entitle you to money. If, for example, you cut yourself slicing a bagel, your landlord isn't responsible for that AT ALL, so you can expect to be ignored forever.

sign up for prepaid legal service. Look them up online! I have them you will not be ignored!!! they will help you if you are really hurt! There is sooo many people tring to get money for a bump and bruise most lawyer wont hear them...i think is good. If you have a serious case they will help you!

1 - Do NOT talk to your landlord's insurance company. Do not talk to any insurance company except your own. If you make any sort of agreement with them, including paying for your medical bills, you just compromised your lawsuit.

2 - Get a better attorney. They may not be calling you back because either you dont' have a very strong legal case, or your injuries may be too minor for a full blown lawsuit with trial. And if they have too many cases now, it's a matter of work load to return. If you had 4 job offers, wouldn't you take the highest paying one? Sounds harsh, but there's only 24 hours in a day, and they are Lawyers out to protect the injured, but they need to get paid too, or else, why do it?

Just keep calling various firms, but stick with healing yourself first, getting an attorney second.

Personal injury lawyers have to contact your insurance agent, the landlord, and the company to make sure it's legit. If the insurance company doesn't feel it hindered your life in any way to compensate you, they won't. Unless you getting hurt made it so you couldn't work for a period of time or had to go to the hospital, they really don't need to do anything. Who you really should contact is your landlord since you got hurt on his/her property.

It sounds as though you reported the incident to your landlord's insurer. If this is the case, did they give you a claim number? Were you given the name of an adjuster? May I suggest that you contact the insurance company, and speak with the adjuster assigned to handle your claim. When I was handling claims, we had 24 hours to make contact with a claimant. Either for some reason your claim as not been assigned, or the adjuster has an insane work load. If you do not get anywhere, politely ask to speak to a supervisor. I guarantee that you will get the claims process moving forward(I would know, I was also a supervisor). The adjuster will want to take your statement. It may be recorded. They need your version of the loss to properly investigate the claim to assess liability. The mere fact that you injured yourself on the landlord's property does not automatically make him/her liable for your injuries. It could be that the insurer found a third party, i.e. maintenance crew, that was responsible for the maintenance of the property. They may have placed them on notice of the loss and are waiting for their response. Your landlord's insurer should be providing you with the status of your claim. Some states require such status reports to be put in writing every 30 days. Since you were injured only 3 weeks ago, this is a relatively new loss. If you are still treating, you are not in a position to resolve your claim now.

For now, try working with the insurance company and avoid retaining counsel. They will only take at least 30% of your settlement. Call your landlord and let him know that his insurance company has not contacted you. He will likely call them directly to find out why. I am sure he is paying a deceit premium. Sending bills to your landlord does not do anything. He will just send them to the insurance company.
