Don't do it that way, because you will miss something that is special to your situation. Get a lawyer. You can get a will done for about $100. |

Part of how you do a will is going to depend on which state you are in.
Also, make sure that every account, property, etc. that is named in the will also had beneficiaries named in the accounts themselves. For propery, you can get a TOD at your county courthouse typically.
A will alone will not avoid probate--making sure every asset you have is aligned with your will is going to help tremendously. |

There is software to do this for you. It's better than hiring a lawyer. This is fine if you are not a super wealthy dude w/ lots of money. Then again, a super wealthy dude probably already has an army of lawyers.

I am legal counsel to a couple of companies and wrote my own will, which has been checked for accuracy by various attorneys. I can provide you with it for a reference if you'd like. Once you find a good template, you just fill in some basic information from there. If your assets and distribution are a little more complicated, it would be very, very wise to have it drawn up by counsel; if they are relatively simple (<$1m with simple distribution), then filling in a template will suffice. Just ensure that the templates have been written by lawyers for maximum efficiency whenever the will must be executed.

I would suggest if you want to make it so that your family doesn't have to pay Probate. I would suggest that you also have a Living Trust done along with your will. It will be faster for who ever you are leaving your things to.
My mom had a Living Trust and we didn't have to pay probate, and our trust was all wrapped up with in like 6 months. It makes it really easy to complete it. Wills can take up to two years to complete and are such a pain to go through.
The only draw back to one is that you pay more to have it done than you do with just only a will, but in the long run it is way better as you can totally have your say as to how thing are done.
You can talk with a lawyer for free. You can get a free consultation with an estate attorney. That is what I did to find out certain information. Worked out pretty well for me to be able to know what rights we had. |
