It depends on the insurance company. Many years ago there was no problem (Your hypothetical son would be convicted of UT40 which is a serious offence) but the insurance company would pay out.
However there have been cases of fraud and now quite a few insurance companies specifically exclude theft by family members.
So read your insurance policy document and see if there is an exclusion under the theft section of your policy.
(For the sake of completeness: some parents when faced with the realisation of the offence that their child would receive stated that the child was driving with their permission - and so the child would get an IN10 and a BA20 and the parent an IN12 and BA22) |

Most likely there would be an issue with the car being in the UK, but if he is a resident relative ( meaning he lives with you a majority of the time and is a relative) then permissive us is implied. |

The question is whether your son is a listed driver in your house hold. The relevance to which ...if he took the car with out your knowledge and consent you can make a claim.
If he is Not a listed driver and resident of your household and took the car with out your permission then you must file Auto theft charges against him to cliam on your poilcy.
The key is his residence and permission. |

If you don't file theft charges against him, then he is presumed to have your permission. The claim would be a collision & liability claim.
If you file theft charges, he'll be prosecuted & sent to jail for auto theft, and the claim would be a theft claim.
You can't call it a "theft" claim if you refuse to prosecute, or drop charges. |
