Apparently you drove around with out insurance - hit someone's car - caused damage to their property and person - now think that because you don't have a lot of money and kids you should get a free pass? That you should not have to bear the consequences for your choices? Your very bad...very irresponsible choices that put the rest of us at risk?

And you think a court officer- a judge- is going to say....ok...life dealt you a lousy hand....you get off scott free....be sure to drive around un or under insured and put me, my family, my friends at risk! Have a nice day now.

I suspect that the judge has heard lots of sob stories.
The insurance company will sue you - they will get a judgment against you - they will keep the judgment on the books and it will jam up your financial future for years and years to come. They may turn you over to collections and suspend your drivers license.
If they are suing you -it's because you ignored their prior communications.
Here's what I'd do - call the insurance company - tell them about your situation - offer to pay them 50 per month until the debt is paid in full (240 payments). They may not take that - they may want 100 per month or more - but try it. Remember, your financial situation is not their problem. Your financial situation is not the problem of the guy you hit. As long as you make your payments on time- every month - they will not take further legal action against you. Since they have already turned it over to a lawyer and incurred those fees - it may be too late -but it's worth a try.
Sorry ...but your poor financial situation is not an excuse. |

Well, I assume you do not have any insurance of your own. That was your first mistake. Why would you think that you would not have to pay if a judgement is found against you? If you were negligent, you owe it. The judge may reduce the amount you owe, and you could probably set up a payment plan based on your income level. Sorry, that is just they way it is. I dare you to tell the judge that you are not going to pay. I am sure he/she will sympathize with you. Perhaps you can start cutting back on certain things you do not need, like internet access and or cable tv if you have these. |

If you get sued in court and the company gets a judgment against you , then yes you will have to pay them. Once the company has the judgment then they can garnish your wages, income tax return and monies that you have in your bank accounts and they can put a lien on your car until you pay them.
Do you have insurance now so this doesn't happen again? |

WRONG ! You hit the other person's car, so any judge won't favor you in court. You may have to file for bankruptcy, which will destroy your credit for a long time. They don't care about your living situation. Someone has to pay. Guess who ? Maybe a legal aid group maybe able to help you. |

If a judgement is filed against you, it will appear on your credit report, however, they may or may not be able to garnish your wages or seize your bank accounts. I would suggest that you go to court when summoned and explain your financial situation and arrange a payment plan that you can afford. The judge is not likely to force you to pay more than you can afford.

No...it is mandatory to have insurance in UK....and when you are sued you need to pay...that way India is best no compulsion of insurance |

If found guilty of whatever it is you did to be charged with repayment of $12k, there will be attempts to get you to pay the debit, even if it is set up payments over a long term. The judge may make changes to the amount, but make sure it is written in the paperwork, because if its not in writing, it never happened. |

So, have you notified your ins co of the lawsuit. They should be defending you.
If you don;t have ins, this is the risk you take.Don't count on mercy from the judge. A repayment plan will be worked out, if even if it's $ 50.,00 a month forever. |

They could get a judgement against you. Depending on the state you live in, they may or may not be able to garnish your wages. Otherwise, it would show up on your credit report as a judgement against you. Life is tough, so you be tougher. Good luck and best wishes! |

Yep, you owe it. They'll get a judgement from you, which will stay against you FOREVER until you pay it - once the judgement gets there, they are ALSO entitled to interest on the unpaid balance every year.
So, eventually, they'll get it - they can even attach your wages.
$14K a year, that's only one full time job, at minimum wage. I think you'll need another part time job on top of that. |

If a judge rules that you must pay, then you must pay. Bankruptcy might be an option for you, but you need legal advise. Check with your local legal aid society, they provide no cost or low cost counseling. |

If you had insurance, your insurance has to pay (unless certain exceptions that you do not mention apply) up to the policy limitations (generally at least $10K for damage to the car and at least $25K for injury to the person). If you did not have insurance, you will have to pay. Also, if you were driving without insurance, there is a big fine to the government and/or loss of your license and/or loss of your car. |

As stated before, you'll pay it. I worked for a carrier in the past and they never sent anyone to collections in your situation. It's a lost cause. They can write off the loss. However, the judgement will stay with you forever until you pay it off. As state before, you should contact that carrier that is suing you and offer to make a payment plan that you can afford. Even if it's $50 a month, they'll probably take it depending on the carrier. Something is better than nothing and you'll eventually clear your name. |

If you go to court like the other person said you can arrange a payment plan but they will add all type of charges so it will take you forever to pay. We just went through something like that and they will add attorney fees, filing fees, and the maximum interest your state will allow so you will end up paying them twice as much as they were asking for in the first place. I say if you can't afford it file bankruptcy. Lately companies have been suing for all types of debt and they have the right to they just don't write off anymore. They don't understand your circumstances and they don't care either. There at the court when we were trying to explain our situation the guy representing the company said I am just here trying to get their money he basically didn't care what we had to say. I ask if he can lower some of the fees and he said no. So, I will file for bankruptcy even if it messes up my credit for 7 years. |
