About a month ago, I rear-ended someone doing about 15mph while slowing to a stop. The lady that I hit had OnStar and she requested that EMS come and take a look at her. They apparently reported that she had an eye abrasion and that she was shaken up.
About a week ago, I received a message on my answering machine that she has appointed an attorney for her injuries sustained in the accident. I'm only 18 years old, and I've had a clean record of driving, with no moving violations or accidents with other cars (the only other accident I was in was a collision with a deer).
I'm scared to death about what's going to happen... like if my parents are going to lose everything and that I hurt this woman completely unintentionally. (I am insured, by the way)
I'm just wondering what am I going to expect within the near future. Thanks. Additional Details My insurance company was contacted, and I didn't even claim any damages, because I didn't even hit her at a rate of speed where damage was caused on my car.
Her car had minor cosmetic damage to the back bumper, and a crunched license plate. |

First, just because someone has hired a lawyer doesn't mean they're going to file a lawsuit. Many people hire attorneys when they get into an accident because they don't want t o handle the hassles themselves, or they want to get as much money as possible, or any combination of the two.
You can relax. This is why you pay those crazy insurance rates. You can call the attorney's office and give them the claim # and your insurance company's name and phone number, and that's likely the last you'll hear from their attorney.
Your insurance company's claims adjuster will likely contact you to get your version of events and often take a recorded statement over the phone. You may also have to complete a written report. You won't have to give a deposition unless an actual lawsuit is filed - something very unlikely in a minor incident like this.
Your insurance rates will likely go up, but that would have happened whether she hired a lawyer or not. If you have no further accidents or tickets for three years they'll likely remove the surcharge.
Don't worry about what the lady winds up getting or not getting. You don't have any control over it, and the amount she gets likely does not affect the amount of your surcharge. Besides, because she hired a lawyer she'll only get 60% of any award anyway.
Try to just be zen about the whole thing. No one was seriously hurt, your car isn't damaged, and you're insured! Accidents happen. We just try to have our experiences teach us something.

Relax....You will have to go and give your statement at a lawyers office or court house.This is called a deposition..Everything you say will be recorded by a stenographer .This is standard procedure.Her insurance rep will ask you lots of questions ( your ins rep will be there also) like what were you doing afew hrs before the accident up until you had the accident.What was the weather like that day, Were you distracted by a loud radio playing in your car,did you drink,are you on medication. Alot of annoying questions.This is done to prove you were in the wrong and than the insurance co. will haggle back & forth on a monetary award to settle the claim or decide on weather to go to trail with it.Nothing bad is going to happen except your insurance rates will go up a little. |

she can sue you for everything you have BUT she wont win. call your insurance company and let them know whats going on and get them involved. they have lawyers to represent you. you do NOT need to hire one and pay for it. this is what you pay insurance for. she didn't get seriously hurt and your insurance is not going to pay anything but what she deserves to get. she will have to PROVE that something happened in order to win a suit against you. she wants money and figures this is her way to get it....even if she sues you personally no lawyer would let her win this unless there is something more to it you are not telling us. |

If it was your car, then your parents don't need to worry. You are an adult and responsible for your own actions. If it was their car, they can be named in the suit, but I am not sure what their negligence would be in the case of you hitting someone.
You will need an attorney for this one. If it was your parents car, call their insurance agent to see what they tell you. He/she will have some experience with this type of situation (or can call someone to find out).

Relax and let your insurance company handle it from here. They will negotiate on your behalf and, if necessary, hire a lawyer to defend you. I just hope your liability limits are sufficient to cover all of this. |

Let your insurance company handle it.
If you or your parents are worried about how much coverage you have, then you need to review your coverage, and increase your limits. It won't help for THIS accident, but it will for the next one. |

Some months ago I bumped into the back of a car that was in front of me as the man drivng the car started to move off at a junction and then suddendly slammed his breaks on. There wasn't much damage to the cars, his had a dented bumper and his trailbar had been pushed in a little, my car had a cracked number plate and a tiny dent on the bumper. The man has been paid out by my insurance company, but was after more money. I have now been sent a letter asking for £2,000 for car hire. Can he sue me for this? |
