John was drunk and driving a car, he struck with another vehicle, and injuring Linda, the driver of the other car. John has limited assets, and his insurance had just expired, as well as his driver's license.
My question is, does John have to spend some time in jail or not? |

First, John is an idiot for driving drunk.
Second, it depends what the law in his state says.
Third it is up to the DA, and then the judge.
Fourth, if Linda sues John in civil court, she can't send him to jail, but she could sieze whatever assets he has. |

More than likely, yes. First time offender (if he is) he may get community service, but this is highly doubtful. |

Depends on what the judge says. Most of the time, driving without insurance will NOT get you jail time, and a first offense DUI won't get you jail time, either.
So, there isn't enough information. Certainly, jail time for John is not determinable from the information provided - which would need to include the STATE, and the DUI penalties. |

depends on the jurisdiction and if this is a first time dui. jail isn't directly about finances (i.e if he can afford a good attorney, he'll probably avoid time). |

there are 2 separate matters here. John should go to jail for A) driving drunk and B) being a dumb asshole.
Jokes aside a DUI is a criminal offense as far as I know in all 50 states. Depeding on the state depends on what consequences happens to John.
2nd if John seriously injured Linda, she could hire a lawyer and sue the **** out of him regardless of what assets he does or does not own. In the end she would get as much as he is worth be rewarded a claim settlement that could force him to pay for years to come!
Bottom line...insurance is for real...carry it or pay heavy consequences |
