They can win a judgment against you if they prove their case, but collecting it will be difficult.
It's their ethical obligation to see if you have the assets. If they don't think they can collect it from you, they may not pursue it. |

Not to point a finger, but this is exactly why everyone needs to have the proper amount of insurance.
Your question asks what the insurance company will do about this but you also say you don't have insurance. That leads me to think that this might be auto related and that the other insurance company has settled with their insured and is now coming after you for repayment. Is that the case?
If you don't have the assets or income to pay a judgement, it will always be there and held over your head. Get an attorney to represent you and try to keep any judgement as small as possible. Try to pay it off. Otherwise, it can prevent you from being able to live your life the way you would want to.
If you are at fault and have caused another party harm, it is your ethical duty to make restitution IMHO. |

Pretty rare for someone to sue a person with no assets. It may not be for the sake of recovering dollars, but for emotional reasons.
I don't know how insurance will play into this, if you have none. If you mean the other party's insurance, it might cover an uncollectable portion (for example, uninsured motorist coverage), but may require the suit. Also, winning the suit, but not being able to collect, may allow the other party to make a tax deduction.
It's not the job of the courts to factor in your ability to pay when deciding how much, if anything, you're liable for.
If you're a student, there may be a Legal Aid society on campus - get their advice. |

First of all, you don't give much information regarding why you are being sued, if the plaintiff has any kind of case, and if you have any insurance that might protect you. Please provide more information.
In general, and I'm not an attorney, so you can't sue me if my advice is wrong, if you have no assets, you don't have many concerns. Tell the plaintiff that they are wasting their time, and they might go away, because it can cost upwards of $20,000 just to bring a lawsuit, and if there is no chance of collection, there is no reason to push forward.
However, the plaintiff has ten years to collect the judgment, and they can take up to 25% of your pay if you are employed, and up to 100% of your pay if you are self-employed, so this can make a difference.
Since you are a student, you may have future prospects that could cause you to have to pay this off at some point. If the plaintiff is able to personally serve you every ten years, then this matter could follow you (potentially) forever.
Get a public assistance attorney to help you out with this, so that you make decisions that are in your best interest. It is folly for someone to sue you if there is no chance of collection, but if you can make this matter go away for a smaller amount, go ahead and settle.

Well, you need to hire a lawyer to defend you. If you have virtually no assets because you're a college student, presumably, some day you're going to have a decent salary. They're going to try to get a judgement against you, and will be able to attach your wages, until it gets paid off.
Not having insurance and not making any money now, will NOT protect your future wages/assets. That's what's at risk right now.
If you think you've got a snowball's chance in heck of getting out from the $100K, hire the lawyer. If you think that amount is fair and justified, no use paying a lawyer, on top of everything else.
You're going to end up paying this, if it's a debt. If it's an injury case, and you live at home, maybe your parents' insurance will cover you. Otherwise, well, you're going to be regretting not having insurance for a long, long time. |

Can't say with so few details, but if the court rules against you the court can issue a judgement against you for FUTURE earnings and assets and that judgement is renewable so ultimately you'd pay. |

my husband hasnt drove his motorcycle in years it was in storage since Im not working and his on disabilty. we were selling it my husband started it drove it down the block 3 houses he loss control do to something sticking and hit a car of course no insurance on bike . he was ticketed paid fine the people who was going to buy it took the bike free cost them $200 to fix the bike but now the other drivers insurance wants $7000.00 to cover his vehicle we r surprise on the amount since th bike wasnt that much. but we dont have that kind of money but we r selling a truck for $3000. how can I offer that amount and call it even Help dont know what to do I can always use that $3000 to file bankrupcy but Im confused appreciate any thoughts |
