NO this is not true!
If he works and the insurance is provided by the employer she can qualify for COBRA through the divorce/separation clause. Also, she is entitled to continue these benefits for 36 Months - not 18 months - this is because of the above mentioned clause.
Qualifying Events for Spouses:
Voluntary or involuntary termination of the covered employee's employment for any reason other than gross misconduct
Reduction in the hours worked by the covered employee
Covered employee's becoming entitled to Medicare
Divorce or legal separation of the covered employee
Death of the covered employee
After she fulfills her COBRA obligation she can qualify for a HIPAA plan.

There has to be some kind of guarantee issue coverage in the state they reside in. That is part of the HIPAA Federal Laws. Either the insurance companies that do business there cannot turn them down, or there is a High Risk Pool they can be a part of. The premiums are high, and the coverage is limited, however. Usually the lifetime maximum is $500,000.
Other than that, she can get a job with group health benefits and get her own coverage. Another part of HIPAA law is the portability of coverage if there is no more than a 63 day lapse in coverage. Contact an independent knowledgeable agent in your area to assist you. |

That may not be totally true. In some divorce situations, the ex- can stay on the same medical insurance until they remarry or are able to get insurance of their own thru work or whatever. It might depend on the state, but it could be based on individual settlements.
I've seen it where the new wife has the ex and the kids on her plan. |

It may be very difficult for her to get insurance coverage, especially if her current health problems prevent her from seeking a job on her own that would come with health coverage. Also, depending on the plan, pre-existing conditions might not be covered.
This puts you in a very tight spot, of course. If you were to discontinue the relationship because he refuses to get a divorce, I don't think anyone would be able to fault you. If you love him, and truly feel that his previous relationship is over, he might just be a really nice guy who remains friendly with his wife.

I would NOT be in a relationship with a married man. Period.
Yes, if they get divorced, she'll have to come off his health insurance. She'd have a tough time getting coverage on her own, unless she's disabled - then she can get medicare. If she's NOT disabled, then she can get it through her employer. If she's not employed, then he's supporting her . .. which tells you EXACTLY where you stand. He's married, supporting his wife. You're the other woman. |
