I am upset with Insurance company after a burglary.?
Insurance claim - does it seem fair or right , that our insurance company is replacing a £250 Sony camera purchased 2 years ago with a Canon £49. With the advance in technology over the last 2 years, the spec, pixels , zoom etc are right up with the original Sony but surely I am entitled to get another similarly priced item? Even though this would probably give me a superior camera than I originally had...does this make sense or are they right by letter of law - they probably are but I feel that this doesn't seem right somehow - if I had purchased the cheapest sony or canon I would have been offered the same Replacement, how can this be right....???

Insurance companies are obliged to offer you the replacement value for the item stolen at the time of the loss. While the item was worth £250 when you bought it, it would have depreciated in value over the two years. If they were to give you a camera valued at £250 now, it would be of a much higher spec than that of your Sony and that would put you in a better position that you were in before the loss. Insurance is supposed to place you in the same position as you were before the loss and accordingly, they are only obliged to give you a camera with the same specs, not the same price you paid for it. Hope this helps.

They aren't primarily basing the replacement on what you paid, they are basing it on what you had. Your 2 year old camera isn't going to be worth 250 now...

If you have an endorsment on your homeowners policy for that camera or have it scheduled on the policy then it has to be replaced. If not then you are suppose to get the money for a new camera at the cost the camera would be now....I wouldnt think they would go buy you a new camera....Ask about getting money instead

you should have gone for a new for old, policy that way you would of got the value of the camera/item you paid, unfortunately that's how insurers make their money from us, they are quick to take out payments but slow to payout.

For items like this they do not replace according to price paid, but according to specification. For items like camera's, dvd players and a lot of other fast improving technology items the claimant will feel cheated with the replacement. But, tecnology moves quickly and camera's that cost 350 new 2 years ago may be no better than ones costing 1/4 of that now. They will not knowingly improve upon the original item.

The insurer is required to replace the property with new property of similar kind and quality. So if your Sony was a 3 MegaPixel camera with zoom, the the insurer is required to replace the camera with a new 3 Megapixel camera with zoom (assuming you have replacement cost on your policy), even though that camera costs less now than it did back then. If they replaced it with a 5 MegaPixel camera then you are put in a position hat was superior than as you were prior to the loss, which violates the whole principle of insurance.

the insurer is correct in this situation, i know this doesnt seem fair and a lot of clients complain about this situation when it arises because they either havnt been explained how it works or they dont understand insurance basics.

1 of the golden rules of insurance in the Principle of Indemnity - this means that the client should, after suffering a loss be put back in the same position as they were before suffering that loss.

In your situation the insurer should in the 1st instance have tried to replaced your camera with the SAME camera - not a upgrade or equivalent current model but the exact SAME model. If that was not available they will try replace it with the same spec AND quality product. If the camera is the same spec you have not arguement there HOWEVER you DO have a arguement in saying that a CANON camera is not the same quality as a SONY camer this is of course subjective to a large degree but this arguement is your best couse of action from what i can see.

think about it if they gave you a replacement of the same cash value who would ever buy something off their own back everyone would just ensure an item and claim every few years pay a nominal excess and make huge gains, insurance companies would go bust immediatly.

2 point someone mentioned new for old policy, just to clarify and not having a dig at anyone ok but New for Old does not mean they give you the same cash value product it simply means what it says, basically you will get a new product for the old one you lost, whilst conforming to the above principle of indemnity.

honestly this company is not scamming you from what i can tell but certainly try to get a sony product if you feel this sony are a better company and to help out find a similar spec sony being sold at the moment and email the details over stating how you feel CANON are not the same quality as you previous sony.

If i can help any further let me know as i worked as a senior insurance consultant as well as complaints supervisor

You're looking for an insurance company to be fair? Man, wake up and smell what's in the air around ALL insurance companies. They aren't there to do right by you, they're there to "make you whole" and absolutely not one pound extra. If you got a better camera they would say you had been unjustly enriched.
