Two weeks ago the insurance I had previously cancelled wrote to me to ask me if I wanted to renew my car insurance, this made me suspicious so I phoned them and they said that I have'nt cancelled it as it is still active and they were still taking the preminums by direct debit from last year. I insisted on a immediate refund for all the payments they have taken, it has been two weeks still no payment showing as they said they have to make the payment back into my account it was taken from. My question is I am entitled to be compensated for this? They have told me the payment will take another week to be returned into my account, surely this is not right, what can I do?

Quick update, I will be checking my direct debits closely in future, and yes I have sent them proof of the other insurance I have had. They have admitted I did request a cancellation but for some reason the person that initially took the call did'nt update the information. Thanks for all the replies. |

wow...an entire year and you didn't notice the money from your account was missing? yes, they HAVE to return any premium taken after the policy was to be canceled. fax them a copy of your dec page from the new company showing the date you picked up coverage with them. you cannot legally insure the same autos on 2 different policies at the same time. its not unusual to take awhile to get the money refunded as they have to go back an entire year...be patient. they will give you your money back. |

You should be okay and get your money back.
You said: "They have told me the payment will take another week to be returned into my account". It sounds as though they are going to refund the money. Sometimes it takes some time for these things to be processed between the banks and the insurers. And it is a common practise to refund back to the account that it was withdrawn from. I beleive this helps to prevent Identity theft, privacy issues, fraud and money laundering.
I hope you recorded the date, time and person that you spoke to that promised the money was coming back into your account.
I am surprised that you did not have to prove that you had coverage elsewhere.
If you don't get your money when they said it is coming call again immediatly!

Wait. They have agreed to refund the money and most brokers wouldn't without proof of a recorded call or a copy of the letter you sent them. Thank your lucky stars you are getting a refund and pay closer attention who you're paying money to by direct debit in the future. |

You will have to prove that you asked for the policy to be cancelled, which may be difficult to do if you cancelled it over the phone like most people do, however some insurance companies will believe you as a gesture of goodwill. They may find it slightly suspicious as it has took you so very long to notice that money is being taken from your account. In addition, it is up to the account holder to cancel direct debits and standing orders that they have set up, not the people that receive them (which is what may have gone wrong here). You will be entitled if you can prove they were at fault. Try writing to them and keeping copies of your letters. If they continue to ignore you then you may be able to persue them through a small claims court, or at least threaten them with it!
On a bit of a different note, you should look at your bank statements more often, there's a scam called 'skimming' where a thief will clone your card, but just take a little money out each month, in the hope that the holder will not notice the money going missing, and let them carry on for months, even years. |

Direct Debits have a guarantee, but not sure if this would be covered. First of all I would talk to your bank. Always check and double check all your bank statements otherwise there could be all sorts of errors and you would not know.I recently had a situation where someone tried to use my credit card on the Internet. Fortunately I check all statements and picked up te attempted fraud.My card was still with me and not stolen or lost |
