6 mos. ago we bought our dream house (it is old but well kept )anyways we are all at work and school and some old guy did the impossible and plowed into the corner of our house (keep in mind we are on an acreage and the house sits at the very back off the acreage--we assume he panicked and hit the gas instead of the brake when he hit the curb to send him careening that far into our yard. It has now been a month--his insurance company wont do anything and their adjuster refused to assess the damage as our custom hand laid brick is damaged and will need to be replaced...our insurance company says they will pay but not for replacement only repair and they are now trying to send out adjuster number 3 to low ball us.....we need this fixed and the only way to properly do so is to replace....we have 2 estimates and 3 other masonry places that wont even estimate it due to the custom hand cut hand laid job....any adivce??....hate to miss the 6th days pay for another adjuster to come out.... |

You're going to have to pay out of pocket to get it done the way you want it done, and then sue the driver in court for the damages.
Keep in mind, his insurance company is only going to pay the LESSER of the cost of repair, or his property damage limit. Unless he's not insured, or excluded from coverage - in which case they won't pay anything at all, you'll have to try to squeeze it out of him yourself.
I'm assuming you've got a "functional replacement cost" valuation homeowners policy - not horribly unusual for an old house, but it does NOT replace with like kind and quality. Your agent needed to explain that to you when you bought the policy in the first place. |

You need to handle it through your homeowner's insurance. They, in turn, may seek reimbursement (subrogation) from the driver's auto liability insurer. |

You have two issues here. First, there should be a policy for the driver that caused the damage. You say that the adjuster won't even assess the damage. Is this because there is a problem with his policy? Contact the adjuster and ask him if policy coverage has been confirmed, and whether they have accepted liability for the damages. If not, find out why. (They should have this done by now.) There might be a problem and he doesn't have coverage. This might be why they haven't even assessed the damage. If there isn't any problem, send them your estimate and demand payment (in writing). If they refuse, and refuse to send someone to complete an estimate, file a complaint with the department of insurance.
If you are forced to file through your carrier, you are bound by the policy coverages. Most policies state that they can repair property if they can. Show your contractor their estimates and see if they believe the work can be completed. If not, notify your company of this. If it can't be successfully repaired, they will have to replace it. |

The insurer of the guy who hit your house is liable for that damage, up to the policy limits of his policy; hopefully he has a decent policy. I'd take the direct approach and send the adjuster a copy of police reports, pictures of the damages and two copies of estimates with a demand for payment.
If you can do it, you may want to coordinate the visit of the next adjuster with a visit from the masonry contractor you want to use. Let the two of them talk while looking at your house and together they can come up with a fair number.
If this doesn't work, get the name of an insurance litigator and sue.
Looking in my crystal ball, I see similar problems in your future. Hopefully it's dawning on you that with an older house, you can't just go to Lowes for material and hire someone off the street to fix it. Specialty work is expensive, you can't just buy the cheapest homeowners policy around.

Then call your insurance agent and see about getting your house properly insured. Without the proper endorsements, your insurer is contractually obligated to fix your house up to modern standards, not 1800s chic.

get it fixed how you want it fixed, then send the insurance companys the bill, if the first company only pays a portion, let the other insurance company pay the balance, look at your contract with your homeowners, they should pay for you to get it fixed and then they should fight it out with other insurance.n Tell them you are keeping track of the time you have missed work and will be billing them for that also. |
