No. Most tooth fractures are due to cumulative stress. The crouton just happened to be the final stress.

Uh no... they cannot be held responsible unless there was something in the crouton besides bread ;-)

10 years ago I cracked a tooth on one of those crunchy Chow Mein noodes .... not fun. Lost a chunk of the tooth and that resulted in a very expensive root canal and crown :-(

Not fun. As another individual answered... your tooth was already stressed... common if you have an old filling perhaps?

They aren't automatically liable - you'd have to prove they knew the crouton was defective, and deliberately left it in your salad.

Conversely, I had a tooth crack one morning when I was drinking a cup of coffee. When a tooth is ready to go (so says my dentist), it goes.

If you want to hire a lawyer to sue the restaurant, go for it. Expect to pay $5K up front to the lawyer. And if the crouton wasn't manufactured by the restaurant - ie, if they purchase their croutons from someone else - you're going to lose.

No, since the crouton was part of the purchased meal. Had you cracked your tooth on a stone or other improper object, you would have a case to claim reimbursement.

Haha sorry but no, that would be like taking Timhortons to court cause you ate chilli and you ended up farting out loud in public and claming they caused Deprivation of Character from it. Sorry but it is a no go

Did you report it at the time of the incident. Did you save the crouton? If you have adequate proof that it was their crouton and the crouton was defective, there is a good chance they'll pay your dental bills through the medical payments section of their liability policy. If not, maybe they'll give you a free meal. Or you would have to sue them on a pretty weak cs.

if you got an attorney . . . maybe, but it would probably cost you a bunch since attorneys are expensive
