You don't have a condo unit owner's policy??
You have no "rights" to protect yourself if someone is suing you for damage you caused to them. Your only choice is to go to court (which means, hiring an attorney), and getting your OWN expert opinons (which you'll likely have to pay for) about how much the damage is. Depending on how much she's asking for, it might be cheaper to just pay what she's demanding.
And tomorrow, get yourself a condo owner's policy. It won't cover THIS loss, but it will cover the NEXT one. |

If your neighbor has called her insurance company, they will inspect the damages and pay what is fair for this claim. If upon their investigation of this claim, they determine that you are responsible for the damages they will then proceed to collect the money from you--this is called "subrogation". However, do not despair--if you don't have insurance or the means to pay the amount in full the majority of insurance companies will enter into an agreement with you to make a monthly payment in an amount that you can afford. However, once you reach this agreement do not stop making the payments because if you do they will take you to court and secure a judgment which will result in you ruining your credit and a probable garnishment of wages.
Also please consider purchasing a condo policy with at least a $500,000 limit of liability in addition to all the other coverages for personal property, loss assessment, etc. The cost is usually under $200 a year and is well worth the peace of mind.

It depends on how your association policy is written. Sometimes your condo assoc., if you have one, carries coverage on the building itself. In that case the assoc. policy should cover the damage, not you. It is also going to depend on if the damage was caused by you or if it was something like a pipe breaking.
I would start by asking your association if they have a policy that covers the building. Then go from there.
Next, Go get a condo owners policy. If you have financing, I'm suprised the bank would not make you get one. Either way, go get one ASAP. They are very affordable. |

If she's claiming from her insurance then perhaps she wasn't planning on making a claim from you. You would need to have a contractor come out to inspect the damage and give you an estimate as to how much the repairs will cost. |

How exactly did the damage occur and why do you feel that you created it? It may turn out that the Condo/Strata association may be responsible for the damage depending on the source of the water escape. |

You can require documentation from the contractor that the damage was caused by you property. Get a second opinion, if your property was the cause then it is your responsibility.
Her insurance may pay her for the damage, but they will then look to you for repayment.
Start with a second opinion...it may not be your problem
