Ok, I am 19 years old, I was married Novmeber 18th,2006 and I turned 19 Oct.11th, 2006. I lived with my mom until november 18th, and was on her health insurance ect.. and once i got married and moved out they took me off the insurance, and now she insists she gets to claim me, but I read my husband is soposed to claim me. I dont knwo what to do, I made 1393.50 from one job and about 8000 from another job, and I dont know how to file this year. Please help |

If you are married filing jointly with your husband, you are then not a qualifying child with respect to your mother - a "qualifying child" cannot be married and filing a joint return with their husband.
If you file seperately from your husband, then she can only claim you as a dependent if neither you nor your husband owe any taxes on your seperate returns. |

I'm not really sure about the time that a child has to live with their parents during a year for the parent to claim them. She actually has 10 months (until you were 18) to be able to claim you. Now that you are married, you need to file joint and claim both your husbands and your income together and you will get a bigger tax break and perhaps a larger refund. You need to check with a tax prepairer, your mother may be able to claim you for 10 months, and you claim yourself for 2. Being a mother, I would, and have, gladly given my child the right to claim herself, even though it ment my tax break wasn't going to be as large. It's a mother-love thing. Since you worked you can claim yourself because by the looks of it I take it you supported yourself? If not then you lived 10 months of the year with your mom and if she paid over 50% of taking care of you then she can claim you. Your husband can not claim you until next year. |

I would suggest that you talk to a tax adviser on this matter. There are some low cost options and some would even answer your questions for free. I would check out H&R Block or Jackson Hewitt or even the local library. I know that where I live the local library has tax volunteers to help file and answer questions. |

mbrcatz17 is right, and also, the IRS considers you married for the entire year, no matter when you got married, rather it be you got married January 1 or December 31, 2006. |

This is touchy. It can go either way this year. Your mom paid for you for 11 months of 2006, and your husband only had the right to claim you for about 6 weeks. It seems right that your mom would claim you this last time. But on the other hand, if I have a baby on December 29, I get to claim that child for the entire year. They can't both claim you or that could spark an audit. If you file a joint return with your husband then it might force your claim to go to him. |
