If you sent them the unsigned check, there is no way they could have cashed it. You need to call your adjuster, and have them re-issue the check. Have the adjuster make it payable to you and the contractor, instead of you and the mortgagee.
When the adjuster pulls the check, they'll see you didn't endorse it, and yank the funds.
Why did they do it? I'm guessing some minimum wage employee saw it, and just put it against your mortgage balance or something like that. Someone at the MORTGAGE company should be telling you what happened to the money. But you'll have a faster time working through the adjuster. |

technically the bank owns the house. They need to ensre the money is used for the repairs and that you dont just walk away. They did that to me after a tornado. Talk to the bank. |

They have a lien on your property. Whenever selling a car or house with a lien the check goes to the lienholder. |

The lender is the actual owner so it can be confusing .
Since the $$$ went into escrow , you should be able to deduct that amount from your next payment and use that to pay the contractors
Or maybe the contractors are to bill the lender ?

i'm a claim adjuster so i deal with this all the time. since you are still making payments on that house, the settlement check will be in your name and the leinholder's. now, if you know who will be repairing your house, you can have your insurane company cancel the first check and rewrite it with your name and the contractor's name. |

The lien holder cashed check and put funds into escrow account. Construction work is done in stages, after each stage homeowner or contractor need to call loan company and they will send one of their inspectors out to confirm completion of work. Loan co. then will disperse part of money. Usually loan companies will tell you what needs to be done prior to them dispersing first part of money.
Are you using a contractor that your insurance company sent or are you using your own contractor? In the State of California it is illegal for contractors to ask for full payment prior to completing job. They can ask for a Down Payment – If they do require a down payment before
work starts, the down payment can not be more than one thousand
dollars ($1,000) or 10 percent of the contract price, whichever is
less, for a home improvement job.
Most likely an inspector will come out once disperse half of the repair money and a few weeks later depending on contractors completion date will disperse the other half.
Loan companies hold insurance money to insure work is completed, They are protecting there investment/property. |

In the case of a check made out to you and the loan company, they can't cash it without you. If it was made out to just them, they can do what they want since they suffered the loss in their asset. |

Hire a new contractor first, if they are too small to fund the work be careful. The bank will work with you on a payment schedule and so should the contractor. It is usually known as a "draw" system. When parts of the work are completed to your satisfaction a "draw" of money is issued to you and the contractor. Just so you know some lenders are hard to work with. |
