I was rear ended in an accident. Called 911 and the police was not dispached. I did not ride in an ambulance but went to the ER about an hour later due to back spasams. I told the ER doc i was not wearing my seatbelt. Will I now be responsible for the medical bills due to not wearing a seatbelt?

I live in the state of Oregon, and I was driving, No passengers in my car or the party's car who hit me.

You do not even have a police report.

Your own health insurance will cover this. The driver of your car might be held liable for allowing you to be without a seat belt, but not the other driver.

If Oregon is a comparative negligence state, then yes, the seatbelt factor will affect you. You can be held partially responsible for your injuries through negligence.

Usually, insurance companies will hold the back car responsible when determining liability (few exceptions apply).

My best guess is that you will be responsible for a very small fraction of your "Reasonable and Necessary Medical Treatment" because you contributed to your injuries by negligence.

The seatbelt doesn't affect the claim.

But in some states, your medical bills are YOUR responsibility, regardless of fault.

So you'll have to ask your agent, what the laws are in your state.
