i had used this lawyer before for a neck injury. he got more money for me when they offered 25. how do i go about getting another lawyer; would present lawyer still get paid along with a new lawyer? Is coming out with 20 good? I do think its unfair. Also I have appt. with a doctor in oct. its more like a 4 hour test to see what i can and cannot do. is waiting to settle a bad idea? could they offer less then I'd have to accept? |

You didn't say the type of accident you have, the type of insurance you claim, the specifics of the insurance policy, no one here can give you an answer.
Without knowing any specifics but based on the little info. you posted, I would say your lawyer sucks, don't settle because it's a bad deal. You still have pain and can't function normal, you need to negotiate for future medical costs also. As far as how this lawyer being compensated should you hire a different lawyer, you need to read the contract you signed with him at the time you retained him. |

How much is the pain going to cost YOU for the rest of your life???? Get a new lawyer. This one just wants his fee and wants to go on to the next one. However, If you have a history of collecting because of many accidents, they just may be on to the gig. |

If I were in your situation, I would wait until the test that your Doctor will give you in October. Determine exactly the extent of any permanent injury, the likelihood of your full recovery, etc.
I am sorry to say this but it seems as if your attorney might be a little more interested in the money than your health. Your attorney will not be with you in 5, 10, 15 years when you are having trouble climbing stairs due to this injury and I can assure you that you will probably have spent all the money.
Your health is your first priority and you need to fight for it. Depending on what the doctor says have your attorney give you his assessment and then get a 2nd opinion from another attorney. Also consider a 2nd medical opinion if you are at all unsure. Once you agree to that settlement, you will not be able to get another go at it. Therefore you need to make sure that all possible future medical expenses, rehabilitation expenses, possiblity of having to get a different job since you might not be able to perform the same job you had before, etc. are included in the settlement and I seriously doubt the amount you were stated comes anywhere near including any of that.

You need to know if you're lawyer is BSing you so he can collect his payment easily or not. I would consult with another lawyer to get a 2nd opinion. |
