I had an heart attack while on the job working for a rental furniture company 2 years ago.Never recieved comp.
I was on a delivery with a guy while deliverying a 65 inch tv and started having chest pain. Went and sat in truck. Passed out and had heart attack.Recieved by pass operation. Was fired for missing four days from work. Never recieved workmans comp.

yep, in many states, just the fact that you had a heart attack at work, does NOT mean the job caused it. A bypass indicates to me that your arteries were clogged. So if the heart attack was caused by clogged arteries, well, WORK didn't clog them!! So the heart attack was going to happen, SOMEWHERE.

That makes it non-compensable. WORK didn't cause the injury. High cholesterol/clogged arteries/eating habits did.

Hope you're feeling better. And that you've found a lower physical activity job. On the bright side, you SHOULD have been able to receive unemployment compensation.

I'm sorry, but I don't believe that in most cases a heart attack will fall under workers comp. In many cases, a heart attack is related to the overall health of a person - heart disease, high blood pressure, coronary artery disease, etc. None of these things would be caused by working for a rental furniture company. My question to you is did you actually try to file a claim? And if so, what was the outcome???

unfortunately, you are unable to claim compensation just because you suufered a heart attack while working for a company. They didn't force you to exceed your body's capabilities, you did.

In a way, though perhaps disappointing for you, it may be a good thing.

After all if anyone could claim from the company they work for should they suffer from heart disease, or diabetes etc. The companies would not wish to employ anyone with even the slightest risk. So very medical examinations would be the 'norm' and any irregularity would result in people not getting the work they need.

I have had four heart attacks, over the years, and have suffered from diabetes for 43 years now. I would have been unable to get work if the companies had insisted only on the fittest and most healthy employees. (That I didn't have a single sick day off in thirty five years would never have got tested) I would have been unemployed and without money.

Most heart disease, like mine was caused by not taking good enough care of my own health. I over ate and ate plenty of the wrong things...I could never have blamed that on the company I worked for. Nor should you.

Think yourself lucky you have the chance to continue living and working, take a job where the physical exertion is not beyond your body's capabilities and enjoy the rest of your life.

Depending on what state you are in you will have to prove that the job caused the heart attack "job related". Other states say that pretty much anythinng that happens while on the clock (even preexisting conditions) are to be considered job related.

Check with your local workers comp office.
