At the beginning of this year I was supposed to receive health insurance through my employer. I can't go into all the details, but in a nutshell, I made numerous calls to my HR rep as well as the corporate Benefits Center, talked with my supervisor and yet it took 4 months for me to get my coverage because for some unknown reason I continued to show up in their system as a former employee who was ineligible. Shortly after the problem was cleared up I left the company. Now ironically, they apparently don't know that I am no longer an employee and I am still receiving benefits! My benefits should have ended back in May, but they failed to notify me or offer the COBRA option. Apparently they still have me listed as an employee with coverage. Now if I continue to use my health coverage, and they later find out that I left the company in May, can they turn around and hold me responsible for whatever they paid out?
Normally I would just call them and notify them of their mistake, but this is a result of their remarkable incompetence and I'm not inclined to call them again after I already called them numerous times while I was an active employee, yet it took them 4 months to give me the coverage that I should have had at the beginning of the year!

~~Yes, they can hold you responsible for any medical costs you incur after leaving your employment. The best advice is just to not use the insurance, to avoid a mess later. Good grief, that company has huge problems, glad you left!~~

Do not use your benefits under any circumstances. Once the group realizes their mistake, they will have you cancelled back to May. The insurance company will then bill you for any and all services you had.
Furthermore, if you want COBRA, you can still elect it. However, you will have to pay premiums back to May because there can't be a lapse in coverage.

Do not use your benefits. Call your HR department and ask for any type of refund they may owe you and that they send you information on your COBRA eligibility.

One thing to note is that as long as you are reasonably healthy then you can almost always find a much cheaper health insurance plan on the open market instead of taking the COBRA offer.

The employer can retro-actively end your coverage back to May, so if the insurance pays claims for you between then and the time they get around to ending the coverage, they would then take back any money paid to your doctors, hospitals, labs, etc and then those providers will in turn bill you.

There is a simple solution--do NOT use or attempt to use the insurance for any purpose. If they try to bill you for the benefit (or send you a W-2), you can fight it by saying you didn't know you had coverage.

If you do use the insurance, that's fraud and your freeloading will eventually cost you money.

They could absolutely make you responsible for the covereage after your employment ended. Depending on the circumstances - how many healthcare services you used during the post employment benefit period - you may be able to compel them to offer and institute the COBRA option. However, be forwarned COBRA is very costly. Don't use the insurance any longer, persue other options if availble. There incompentence doesn't change the fact that you are no longer an employee.

You may possibly get done for benefits fraud if you do not.
