None. You got fired because you didn't show up at work. Sure, you didn't show up because you got hurt, but they aren't REQUIRED to hold your job open for you. |

you can't and don't want to sue to get your job back. They will find a reason to fire you later if you did anyway. What you want to do is go to a "free initial consultation" with a workers comp lawyer and do you have any limitations whatso ever...any mental strain or stress or inability to do ANYTHING that you could do before? If so you want to sue for that. |

Your best bet is to move. In "right-to-work" states like Florida they do not have to fire you for cause.
Which means that no, you can't take legal action. If you don't believe me, go apply for unemployment and tell them the whole story. They will give you all the legal answers for free, and you might get some unemployment compensation for a while. |

You have no action what so ever. Do you have restrictions with your return to work? If you can't do the minimun requirements for the job, they don't have to keep you. Plus, I think Floria is a right to work state, and if that is the case, they can let you go for any reason. They paid your workman's comp, that is all that they are responsible for. I am sorry. You would not get anywhere if you sue, for a matter of fact, no one would most likely take your case, because they know that you would not win. I am really sorry, that totally sucks I know. I have been through the exact same thing when I was younger, and there was nothing I could do about it. |

1) Get a worker's comp lawyer that doesn't take money up front.
They are supposed to give you a job that is about the same as what you were doing before. 2) Call Human Resources if they have that department and inquire there. |
