I am not certain of the laws in your state but I believe that if you write a letter telling them that you are not pleased with their services and wish to cancel your membership then cc the note to a reputable lawyer and a copy to the local newspaper that they will respond favorably. It is amazing how much attention a newspaper AND a lawyer can get from such a group of people. They do not want to have a lewsuit or the news-people to be "all over their business". I hope that this helps. Let me know what happens.

Most states in the U.S. have passed consumer protection laws regarding health club memberships. Many of these states (such as mine) require health clubs to release consumers from contracts if they can provide medical proof that they are unable to exercise. (I understand this really doesn't apply to you, since you lied, but it does answer your question.) Your state probably requires other contract termination provisions, as well. Do a web search using the terms "consumer protection division [your state's name] and health club memberships" for more information.
One final thought: many states also require health clubs to register and post bonds if they offer long-term contracts to consumers. Any unregistered gym that's sold contracts is required to release consumers from the contracts. Be sure to see whether your state requires registration; then, call the number listed on the Consumer Protection web page to see if the gym is registered. If it isn't, you can request assistance. |

Unfortunately that's how most gyms make their money. They run a membership drive usually around year end or new year (with the new year resolutions), they charge a joining fee + the monthly fee (or annual fee), people go there for 3 months or so and because they don't have the guts and are too lazy they stop going. In the meantime the gym keep charging them as they signed an annual contract (needless to say that have pocketed the joining/processing fee). That's it...you signed a contract with them and you are stuck unless you can show a real proof of medical problem. Not temporary problem as they will propose to suspend the membership for 3 or 6 months but then will resume it later. It has to be a permanent problem. You signed a contract and you have to pay to the end of the contract. It's a sunk cost for you so you might as well go, work out and enjoy the gym (and the few pounds you will loose). |

this happens often as many people at the moment feel they are going to join and use the gym on a regular basis but soon find its not for them for many reasons. the gyms response is typical and they will not return your money. the only way out is what they suggested or possibly if u sold the unused time on the membership to another person and the gym agrees to the transfer is quite possible. |

No, see, this isn't really a "monthly membership". You pay in full up front, and what they're REALLY doing, is financing the charge. So you're REALLY paying off the initial debt you agreed to upon joining. |

yes. because people sometimes have 2nd thoughts after signing an agreement to join a gym or never wind up going so they wind up lying to try and break the agreement. oh, wait a minute, that's exactly what you are trying to do. |

Unfortunately, the same thing happened to my son. He did in the end get a note from the Dr. which cost him ÂŁ15.00. Even then he still ended up paying for another three months. He had to put a cancellation letter in writing. If it was me, I would ring your local citizens advice bureau, maybe they could give you better advice with regards the contract you have entered into.
