I just got my insurance check with my name and the body shop name on it, do i have to get it fix?

most of the hail damage already pop out because its been 6 months since i file that claim and now just got my check and i don't want to ruin my paint trying to fix it, cause its not to bad now

The law on this is very clear and simple.

You do NOT have to fix your car if you don't want to.

The check is made out to both as a strong inducement for you to get the repair made.

If you do not get the repair made, however, and you have another claim....they will deduct the amount they already gave you from the amount of any future claim and sometimes the deduction will be for more than what you got in the first place because depreciation on an already damaged car that is wrecked is greater than the value of a fixed car that's been wrecked again.

Believe me, you are way better off getting the car fixed than trying to pocket some of the money.

If you want the money that badly.....then just have the insurer recut the check to you and you find another cheaper place to get the work done.....or do it yourself and pocket the difference.

You don't have to repair your car if you don't want to. Request that your adustor re-issue the check in just your name. Your car will be reduced in value if you don't repair it, so the next time you have an accident your insurance company can reduce your settlement because you chose not to fix previous damage. The money they give you now compensates you for the lost value in your car, you don't have to repair.

Yes, especially if there is a loan on the vehicle. If there is a loan on the vehicle and you don't get it fixed, you are probably violating the terms of your loan and can get in big trouble. If there is no loan, you could say you do not want the car fixed, but then you may not be able to get it insured.

Yes. If the cheque is made out to both parties they both have to endorse it for it to be cashed or deposited.

you have to contact your insurance company, but the answer is yes.

you have insurance to protect your car... not give you spending cash

hell no, its your car and your money. Call your insurance company and tell them you arent sure if thats the body shop you want to use and thus you want the check re-issued in your name. As long as the car is owned or financed and not leased, you do not have to fix it and you can keep the money. People do it all the time

No, you don't have to get it fixed, but you can't cash the check until the body shop signs off on it - and they probably won't, unless they do the work.

You can ask the adjuster to re-issue the check to just you, IF you don't have a loan on the car - tell them you don't want to have the car repaired.

Of course, the company can then cancel the "comprehensive" and "collision" coverage from your policy, but that will save you more money!

You have to fix your car. Just like if your child is sick, the insurance company will pay his doctor to cure him. You can't ask the insurance company to pay you directly and not cure your child.
